SEC. 5. And be it further enacted by the General Assembly of
Maryland,
That Section 1A of Article 43 of the Annotated Code of
Maryland (1965 Replacement Volume and 1968 Supplement), title
"Health," be and it is hereby repealed in its entirety.

Sec. 6. And be it further enacted by the General Assembly of
Maryland,
That Section IB of Article 43 of the Annotated Code of
Maryland (1965 Replacement Volume and 1968 Supplement), title
"Health," subtitle "State Board of Health and Mental Hygiene," be
and it is hereby repealed and re-enacted, with amendments, to be
under the same title, but under the new subtitle "Department of
Health and Mental Hygiene," to read as follows:

DEPARTMENT OF HEALTH AND MENTAL HYGIENE
1B.

The [State Board] Department of Health and Mental Hygiene
shall have care of the health interests of the people of this State;
shall provide inpatient and outpatient facilities for the treatment
and care of chronically ill, mentally ill, tuberculous persons and
mentally retarded persons, and shall allow the State Department of
Social Services to provide foster care and the full range of child
welfare services of said Department to said mentally retarded per-
sons; shall provide preventive services and medical hospital and
home-care programs for the indigent and medically indigent; and
shall establish policy for the State Department of Health and the
State Department of Mental Hygiene.

Sec. 7. And be it further enacted by the General Assembly of
Maryland,
That Section 1C of Article 43 of the Annotated Code of
Maryland (1965 Replacement Volume and 1968 Supplement), title
"Health," be and it is hereby repealed in its entirety.

Sec. 8, And be it further enacted by the General Assembly of
Maryland,
That Sections 1D, 1E, 1F, 1G, 1H, 3, 6, 7, 8, 9 and 10, of
Article 43 of the Annotated Code of Maryland (1965 Replacement
Volume and 1968 Supplement), title "Health," subtitle "State Board
of Health and Mental Hygiene," be and are hereby repealed and re-
enacted, with amendments, to be under the same title, but under the
new subtitle "Department of Health and Mental Hygiene," all to
read as follows:

1D.

The Governor shall, upon recommendation of the [Board] Secre-
tary of Health and Mental Hygiene,
appoint a Commissioner of the
State Department of Health, hereafter known as the Commissioner
of Health, who shall be an experienced physician skilled in public
health and who shall be certified by the American Board of Preven-
tive Medicine. [Dr. Perry F. Prather shall become the Commissioner
and shall continue in office as long as he performs his duties in a
competent manner.] The Commissioner of Health shall receive such
salary as may be provided in the budget, and he shall continue in
office until removed by the Governor, upon the recommendation of
the Secre
