at any time without cause. Any vacancy in the membership of the Board
shall be filled by the Council.
(3) The Council may designate one alternate member for the board
of appeals who may be empowered to sit on the board in the absence of
any member of the board; and when the alternate is absent, the Council
may designate a temporary alternate.
(4) Any person or persons, jointly or severally aggrieved by any
decision of the board of appeals, or any taxpayer, or any officer, depart-
ment, board, or bureau of the Town, may appeal the same to the circuit
court of the county.
(5) An appeal may be taken to the Court of Appeals of Maryland,
during the period and in the manner prescribed by rules of the Court of
Appeals, from any decision of the Circuit Court reviewing a decision of
the board of appeals.
(k) The Council may, by resolution, adopt regulations governing
the subdivision of land, which shall be deemed to mean the division of one
parcel of land into two or more parcels for the purpose, whether immediate
or future, of sale or development or the combination of two or more
parcels of land into one for the purpose, whether immediate or future,
of sale or development.
All previous actions of the Gaithersburg Planning Commission and
the Board of Appeals are hereby ratified and confirmed and all zoning
regulations, and subdivision regulations and master plans, or parts thereof,
heretofore adopted pursuant to Article 66B of the Annotated Code of
Maryland by the Mayor and Council of Gaithersburg, or the Gaithersburg
Planning Commission, are hereby ratified and confirmed, to the extent
that they have not been specifically repealed.
I, Harold C. Morris, Mayor of the Town of Gaithersburg, Maryland,
do hereby certify that the foregoing is a true and correct copy of a Resolu-
tion passed by the Mayor and Town Council of Gaithersburg at a public
meeting assembled this 15th day of April, 1968.

A Resolution authorizing the annexation by the Town of Gaithers-
burg of approximately 198 acres of land located to the northwest of
the present corporate boundaries and adjacent thereto and extending
along the northeast and northwest right of way lines of Maryland
Route 355 and 70-S.
Whereas, the Mayor and Town Council of Gaithersburg have received
a Petition consenting to the proposed enlargement of the corporate bound-
aries of the Town of Gaithersburg, so as to include an area encompassing
198 acres of land located to the northwest of the present corporate bound-
aries and adjacent thereto and extending along the northeast and north-
west right of way lines of Maryland Route 355 and 70-S.
Whereas, the signatures of the said Petition of Consent have been
verified and it has been ascertained that the persons signing said Petition
are owners of not less than twenty-five percentum (25%) of the assessed
valuation of the real proper |
