1946                              MUNICIPAL CHARTERS

ascertained that the persons signing the Petition represent 26.5% of
persons who reside in said area and who are registered to vote in
County elections in the precinct in which said area is located, and that the
persons signing the Petition also represent the owners of 27% of the
assessed valuation of the real property located in said area, all as of April
9, 1968, as will appear from the certificate of Irp R. Hobbs, Chairman
Commissioner, duly filed prior hereto among the official records of the
Town of Fruitland (a copy being attached hereto); and

Whereas, it appears that the Petition meets the requirements of law.

Section 1. NOW, THEREFORE, BE IT RESOLVED BY THE COM-
MISSIONERS OF THE TOWN OF FRUITLAND, that it is hereby pro-
posed and recommended that the boundaries of the Town of Fruitland
be changed so as to annex to and include within the boundaries of the
Town of Fruitland all that certain area of land together with the persons
residing therein and their property, situated contiguous to and binding
upon the northwesterly, westerly and southerly corporate limits of the
Town of Fruitland, beginning at a point in the center line of U. S. Route
13 at the Town limits of Fruitland; thence south by and with the center
line of U. S. Route 13 to the southwesterly right-of-way line of County
Route 360; thence by and with the southwesterly right-of-way line of
County Route 360 north to the southwesterly property line of Sara Tilgh-
man; thence by and with the southwesterly property line of Sara Tilghman
and a continuation thereof to the center line of County Route 344; thence
northwesterly to the westerly corner of the Robert Anderson land; thence
northeasterly to a point in the northeasterly right-of-way line of County-
Route 306 at the southwesterly corner of the Orville H. Pryor land; thence
by and with the northwesterly property line of Orville H. Pryor to the
land of Green Giant, Inc., thence by and with the Green Giant, Inc.,
property line westerly to the westerly corner of the Howard Smith land;
thence by and with the northwesterly property line of Howard Smith and
a continuation thereof to the northeasterly right-of-way line of County
Route 302; thence by and with said right-of-way line to the northwesterly
property line of Millard Mezick Heirs; thence by and with the Millard
Mezick Heirs property line to the center line of Tuxents Branch; thence
by and with the center line of Tuxents Branch to the Town limits of
Fruitland, generally subject to all provisions of the Charter of the Town
of Fruitland.

Section 2. AND BE IT FURTHER RESOLVED BY THE COMMIS-
SIONERS OF THE TOWN OF FRUITLAND, that it is hereby further
proposed and recommended that such annexation of said area be made
upon the following terms and conditions:

A.    That upon the effective date of the annexation of said area
hereby proposed, the provisions of the Charter of Fruitland and all ordi-
nances, resolutions, rules and regulations of the Town of Fruitland in
effect on said date shall a
