(s) "Sale" means the transfer of ownership of sod.

(t) "Tolerance" means the allowable deviation established by the
Board under rules and regulations from any figure used on a label.

(u) "Brand" means the name, term, design or trademark under
which any person offers sod for sale.

(v) "Dealer" means any person who sells, offers for sale, exposes
for sale or transports sod for planting purposes within this state
other than a grower making a casual or isolated sale of unsevered sod.

(w) "Records" includes all information relating to the lot, ship-
ment or shipments involved and shall include a copy of the label
pertaining to the lot.

64B.

(a) Every lot of severed turf grass sod, plugs, and sprigs, as de-
fined under this subtitle, which is sold, exposed for sale, installed,
transported or advertised within this state for planting purposes
BY A DEALER shall be accompanied by or have attached to the bill
of lading, bill of sale, sales slip or invoice a label containing the fol-
lowing information plainly written or printed in the English lan-
guage: The recognized common name, the variety or varieties of
each component, the texture, origin, net measure, the number
PRES-
ENCE of restricted noxious weeds per unit, and the name and
address of the person
DEALER who labeled said lot. PROVIDING,
HOWEVER, IF THE KIND OR MIXTURE IS NOT KNOWN,
THAT FACT SHALL BE SO STATED.

The first and each subsequent dealer shall be responsible for the

accuracy of the label required by this section and the informa-
tion on the label shall not be falsely modified or represented in adver-
tisements pertaining to such sod, plugs, or sprigs.

(b) All persons DEALERS transporting or delivering for trans-
portation sod, sod mixtures, plugs or sprigs shall keep for a period
of two years a complete record of each lot of sod, sod
mixtures, plugs
or sprigs sold or offered for sale,
ADEQUATE RECORDS and the
State Board of Agriculture or its duly authorized agents shall have
the right to inspect such records for the purpose of the effective
administration of this Act.

64C.

(a) It shall be unlawful for any person to transport, to offer for
transportation, to sell, offer for sale, or expose for sale within this
state sod for planting purposes:

(1)  Not labeled in accordance with the provisions of this subtitle,
or having an incomplete, false, or misleading label or claim.

(2)   Which has been falsely advertised or advertised in a mislead-
ing manner.

(3)  Containing prohibited noxious weeds in any amount what-
soever.

(4) Containing restricted noxious weeds except as prescribed by
rules and regulations promulgated
