(5)   To which there is affixed names or terms that create an in-
complete or misleading impression as to the kind, kind and variety,
history, productivity, quality, or origin of the sod.

(6)  Represented to be ''inspected," "approved," "certified" "reg-
istered,"
OR "foundation" or "breeder" unless it has been produced,
processed and labeled in accordance with procedures and in com-
pliance with rules and regulations of an officially recognized certify-
ing agency.

(7)   Which in the form of turf sod, or turf plugs do not contain
at least one-half inch of soil and roots
AND which do not remain
intact after folding, rolling or plugging.

(8)  Containing destructive plant pests in violation of Article 48,
Section 56-71 Annotated Code of Maryland 1957 Edition.

(9) Which does not conform to the definition of a lot.

(b)  It shall be unlawful for any person to alter or substitute
sod, in any manner that may defeat the purpose of the provisions of
this subtitle or

To disseminate false or misleading advertisement in any manner
concerning sod, sod mixtures, plugs or sprigs.

(c)  It shall be unlawful for any person to hinder or obstruct in
any manner an authorized agent of the State Board of Agriculture
in the performance of his duties or

To fail to comply with, or to supply false information in reply to
a Stop Sale Order, or to remove tags attached to or to dispose of sod,
sod mixtures, plugs or sprigs held under such order except as speci-
fied by the enforcement officer.

(d) It shall be unlawful for any person to label and offer for sale
sod, sod mixtures, plugs or sprigs under the scope of this Act without
keeping records required by this subtitle

64D.

No dealers shall be subject to the penalties of this chapter for
having advertised, sold, offered or exposed for sale in this state any
sod or mixture in violation of
II, 64B, if he shall have obtained from
his supplier an invoice, grower's declaration or other labeling infor-
mation relating to such sod or mixture and, after having taken such
precautions as may be reasonable to insure their veracity, shall have
relied in good faith upon statements made or contained in such
invoice, grower's declaration or labeling information in advertising,
selling, offering or exposing for sale such sod or mixture.

64E.

(A) The duty of enforcing this subtitle and carrying out its
provisions and requirements shall be vested in the State Board of
Agriculture. It shall be the duty of said Board:

(1) To inspect, sample, analyze, test and examine sod, plugs and
sprigs offered or exposed for sale within this state for planting pur-
poses, at such time and place and to such extent as said Board may
deem necessary to determine wh
