George's County (1963 Edition and 1967 Supplement), and Section
70-94(a) of the Montgomery County Code (1965 Edition as amended)
being Article 17 and 16 respectively, of the Code of Public Local
Laws of Maryland, titles "Prince George's County" and "Montgomery
County," subtitle "Park and Planning Commission," be and they are
hereby repealed and re-enacted, with amendments, to read as follows:

59-88 (70-94)

(a) No clerk of the circuit court of Montgomery County or of
Prince George's County, no administrative official, no licensing body
or board, and no person whatever shall issue a license or permit for
any commercial or industrial purpose or for the conducting of any
commercial or industrial enterprise or business whatsoever in a
residential zone, that is, in any district designated on the zone maps
as residential within the regional district [. Nothing contained in
this subsection shall be deemed to prohibit the issuance of any license
or permit for land or buildings for which special exceptions to the
provisions of the zoning regulations have been or may be lawfully
granted.] unless such purpose, enterprise or business is permitted
ALLOWED by the applicable zoning ordinance in effect in the said
Regional District UNDER PERMITTED USES OR SPECIAL EX-
CEPTIONS GRANTED BY THE BOARD OF APPEALS.

Sec. 2. And be it further enacted, That this Act is hereby declared
to be an emergency measure and necessary for the immediate
preservation of the public health and safety and having been passed
by a yea and nay vote supported by three-fifths of all the members
elected to each of the two houses of the General Assembly, the same
shall take effect from the date of its passage.

(House Bill 1075)

AN ACT to repeal and re-enact, with amendments, Section 59-103
of the Code of Public Local Laws of Prince George's County (1963
Edition and 1967 Supplement, being Article 17 of the Code of
Public Local Laws of Maryland), title "Prince George's County,"
subtitle "Park and Planning Commission," said Section being
also Section 70-109 of the Montgomery County Code (1965 Edition,
as amended, being Article 16 of the Code of Public Local Laws
of Maryland), title "Montgomery County," subtitle "Park and
Planning Commission," to provide that in Prince George's County
the District Council may establish AFTER CONDUCTING A
PUBLIC HEARING reasonable rules and procedures governing
both the cross-examination and the administering of oaths to wit-
nesses appearing to testify at District Council hearings.
