for their reasonable travel and other expenses in amounts approved
by the Commissioner of Labor and Industry.

170.

The Board shall formulate definitions, rules and regulations for
the safe construction, use, installation, maintenance, repair and in-
spection of boilers in this State. The rules and regulations so formu-
lated shall conform as nearly as possible to the Boiler and Pressure
Vessel Code of the American Society of Mechanical Engineers and
to the Inspection Code of the National Board of Boiler and Pressure
Vessel Inspectors as amended and interpreted from time to time.
Rules and regulations formulated by the Board shall be adopted and
promulgated by the Commissioner of Labor and Industry in the
same manner as rules and regulations of the Occupational Health
and Safety Advisory Board established by Section 31 (a) of Article
89 of the Annotated Code of Maryland (1964 Replacement Volume,
1968 Supplement).

171.

(a)  No new boiler which does not conform to the rules and regula-
tions formulated by the Board governing new construction and
installation shall be installed and operated in this State at any time
after twelve (12) months from the date upon which the first rules
and regulations under this Act pertaining to new construction and
installation shall have become effective, unless the boiler is of special
design or construction and is not inconsistent with the spirit and
safety objectives of such rules and regulations, in which case a
special installation and operating permit may, at its discretion, be
granted by the Board.

(b)  With regard to existing boiler installations,

(1)  the maximum allowable pressure of a boiler carrying the
ASME Code symbol shall be determined by the applicable sections
of the Code under which it was constructed and stamped;

(2)  the maximum allowable pressure of a boiler which does not
carry the ASME Code symbol shall be computed in accordance with
the Inspection Code of the National Board of Boiler and Pressure
Vessel Inspectors; and

(3)  this Act shall not be construed as in any way preventing the
use, sale or reinstallation of a boiler referred to in this section, pro-
vided it has been made to conform to the rules and regulations of
the Board governing existing installations and provided further it
has been found upon inspection not to be in an unsafe condition.

172.

This Act shall not apply to the following:

(a)  boilers under federal control OR REGULATION;

(b)   boilers located on farms and used exclusively for agricultural
purposes;

(c)  steam or vapor boilers carrying a pressure of not more than
fifteen (15) psig, which are located in private residences or in apart-
ment houses of less than six (6) family units;
