This Act SUBTITLE shall be known and may be cited as the
Boiler Safety Act and, except as otherwise herein provided, shall apply
to all boilers. For the purpose of this Act, the following definitions
apply.
(a) Boiler—a closed vessel in which water is heated, steam is
generated, steam is superheated, or any combination thereof, under
pressure or vacuum for use externally to itself by the direct applica-
tion of heat from the combustion of fuels, or from electricity or
nuclear energy. The term "boiler" shall include fired units for heat-
ing or vaporizing liquids other than water where these units are
separate from processing systems and are complete within themselves.
(1) Power boiler—a boiler in which steam or other vapor is gen-
erated at a pressure of more than fifteen (15) psig.
(2) High pressure, high temperature water boiler—a. water boiler
operating at pressures exceeding 160 psig or temperatures exceeding
250 degrees F.
(3) Low pressure boiler—a steam boiler operating at pressures
not exceeding fifteen (15) psig, or a hot water boiler operating at
pressures not exceeding 160 psig or temperatures not exceeding 250
degrees F.
(b) Certificate inspection—an inspection, the report of which is
used by the Chief Boiler Inspector to decide whether or not a cer-
tificate as provided for in this subtitle may be issued. This certificate
inspection shall be internal inspection when construction permits;
otherwise, it shall be as complete an inspection as possible.

There is hereby created within the Department of Labor and In-
dustry a Board of Boiler Rules, referred to hereafter as the "Board,"
consisting of five members, which shall be appointed by the Com-
missioner of Labor and Industry GOVERNOR with the approval of
the Governor. ADVICE AND CONSENT OF THE SENATE.
Among the members of the Board shall be one representative of the
owners and users of high pressure boilers, one representative of
owners and users of low pressure boilers, one representative of
manufacturers or assemblers of boilers, one representative of in-
surers of boilers, and one representative of the American Society
of Mechanical Engineers, who shall serve as Chairman of the Board.
Each member of the Board shall be appointed for a term of four
years to serve until his successor is appointed and qualifies. Of the
members first appointed, two shall be appointed for a term of two
years, two for a term of three years, and one, the Chairman, for a
full term of four years. The Commissioner of Labor and Industry
shall be a member ex officio of the Board but shall have no vote and
shall receive no additional compensation for duties performed in
connection therewith. Vacancies shall be filled by appointment for
the unexpired term by the Commissioner of Labor and Industry with
the approval of the Governo |
