(d) hot water boilers operated, at pressures not exceeding 160
psig, or temperatures not exceeding 250 degrees F., which are lo-
cated in private residences or in apartment houses of less than six (6)
family units.
173.
(a) The present State boiler inspectors shall be retained in office
by reason of their having passed the competitive State of Maryland
boiler inspector's examination given by the State Commissioner of
Personnel. At any time hereafter when the office of Chief Boiler
Inspector or Deputy Boiler Inspector shall become vacant, the Com-
missioner of Personnel shall, as soon as practicable, conduct a com-
petitive examination in accordance with State Merit System Law,
the examination to be the same or equivalent to the examination
given by the Board of Boiler Rules for special inspectors in Section
174 of this subtitle. The Commissioner of Labor and Industry shall
appoint from the successful candidates a Chief Boiler Inspector or a
Deputy Boiler Inspector, as the case may be.
(b) The Chief Boiler Inspector, if authorized by the Commissioner
of Labor and Industry, is hereby charged, directed and empowered:
(1) to take action necessary for the enforcement of the laws of
the State governing the use of boilers to which this Act applies and
of the rules and regulations of the Board;
(2) to keep a complete record of the type, dimensions, maximum
allowable pressure, age, location and date of the last recorded in-
spection of all boilers to which this Act applies;
(3) to issue, or to suspend, or revoke for cause, inspection cer-
tificates as provided for in Section 177 of this subtitle;
(4) to cause the prosecution of all violators of this Act.
(c) Deputy Boiler Inspectors shall be responsible to the Chief
Inspector and shall perform such duties as the Chief Inspector may
direct from time to time.
174.
(a) Upon the request of any company licensed to insure and insur-
ing boilers in this State, the Commissioner of Labor and Industry
shall issue to any inspectors of said company commissions as special
inspectors, provided that each such inspector before receiving his
commission shall satisfactorily pass the examination provided for in
subsection (b) of this section, or, in lieu of such examination, shall
hold a commission or a certificate of competency as an inspector of
boilers for a state that has a standard of examination substantially
equal to that of the State of Maryland or a commission as an inspec-
tor of boilers issued by the National Board of Boiler and Pressure
Vessel Inspectors. No special inspectors shall receive salary from,
nor shall any of their expenses be paid by, the State, and the con-
tinuance of a special inspector's commission shall be conditioned
upon his continuing in the employ of the boiler insurance company
duly authorized as aforesaid and upon his maintenance of the
standards imposed by this Act. When such special inspectors inspect
boilers insured by |
