his Attorney Complaineth that whereas the sd Joseph ye 28th

day of July in the year of our Lord 1692 at Pocomoke within ye

Jurisdiction of this Court by his Certain Note Subscribed with

the propper hand of him the sd Joseph , acknowledged himself

to be indebted to the sd John in the full & just Sum of nineteen

Shillings & Sixpence to be paid in Countrey Comodities at

the price Currant ye year ensueing the date of ye sd Note Never

the less the sd Joseph the sd Sum of nineteen Shilling & Six

pence, according to the tenour & effect of the sd Note hath not

paid, although the sd Joseph to pay the Same hath been requested

but hath hitherto refused & doth Still refuse to the damage of ye

Said John of Eight hundred pounds of tobacco & thereof he

brings his Sute &ca. Dent pr Quer Plegs &ca.           Jno Doe

This shall oblige me Joseph Staton me my Heirs Executors

Admrs or Assigns to pay to John Emmett he his Heirs or Lawfull

Attorney the full & just Sum of nineteen Shillings & Sixpence

to be pd in Country Comodities as price Currant doth goe

this ensueing year, as Witness my hand this ye 28th day

of July 1692                                     Joseph Staton

              9ber y3 12th 1695. The above bill Proved in Open

              Court by ye Oath of Hough Conner teste J West Clr Cur

The Declaracon being read & the abovesd proved by the Oath

abovesd, The Dfts Attorney Worthington) Confest judgment

for twelve shillings Six pence, which the Worll Court grants

Order for agt the Dft with Cost of Sute alias Executio.

Emmett of a plea that he render unto him the full & just Sum of one

thousand pounds of good Sound Mertable tobacco & Caske which to

him he oweth & unjustly deteineth &ca. - - - - - - - - -

And whereupon the sd John by Peter Dent his Attorney Sayes

that whereas the sd Howell the first day of June in ye year of or

Lord 1692 at Pocomoke within the Jurisdiction of this Court by

his Certain Bill Obligatory which the sd John with the seal of the

Said Howell Signed brings here into Court the date whereof

is the day & year afd acknowledged himself to be indebted to ye

sd John in the sd Sum of One thousand pounds of good Sound

Mertable tobacco to be pd to the sd John at or upon the tenth day of

November next ensueing the date of the sd Bill at Some
