The Originall Writt being returned Non est Inventus the Declⁿ-

being read & proved y^e plt humbly Craved an Attachm^t might issue

agt the goods &ca for y^e foresd debt & Cost which being Considered was

by the Wor^ll Court granted giving Security according to Law whereupon

Came y^e sd Pirrie & m^r Edward Green & did p^r Recognizance acknowledge

them Selves to be indebted to y^e dft the Sum of eight hundred pounds

of tobacco w^th Condition &ca. That if the sd absent Dfend^t should by

himself or Attorney appear to the Original accon within a Twelve-

month & a day, And make it appear that y^t the plts just debt he

hath Satisfied or any part thereof or otherwayes in bar discount

y^e Same or part thereof, that then the fd Securities will be [responsible]

as the law in Such Cases doth require &ca. //

unto Ephraim Edward Green of a plea of trespass upon ths Case &a.

And whereupon the sd Edward by Robert Pirrie his Attorney Saith

that whereas the Said Swan y^e 11^th day of May in the year of our

Lord 1695 at Snow hill within the Jurisdiction of this Court became

indebted unto the said Edward in y^e just quantity of four hundred,

ninety & five pounds of good Sound Merchantable tobacco & Caske

Convenient at Snow hill Landing as by his Certain Bill obligtry

which the sd Edward with the Seal of the sd Swan bringeth here

into Court Signed y^e date whereof is the day & year afd to y^e which

paym^t y^e Said Swan bound himSelf firmly by the sd Bill, Never y^e

less the sd Swan the sd Sum according to the tenour of y^e sd Bill

hath not paid Said Edward but hath hitherto refused & doth

Still refuse to the damage of the sd Edward of nine hundred &

ninety pounds of tobacco as afd & thereof he brings this Sute &ca.
