The Originall Writt being returned Non est Inventus, y^e Declaracon

red & acco^t proved, the plts Attorney humbly craved an Attachm^t

agt the goods &ca of y^e Dft, which being considered is by y^e Wor^ll–

granted giving Security according to Law, whereupon Came y^e Said

Ephraim & his Security Robert Pirrie & did acknowledge by way

of Recognizance to be indebted to the sd Alexander the Sum of 1200

pounds of tobacco, with Condicon &ca. that if the sd Absent Defend^t

should by himSelf or Attorney come in person and appear to the

Sumoned to answer unto Robert Pirrie of a plea of trespass upon

the Case &ca. And whereupon the Said Robert Pirrie Attorney

Complaineth that whereas the sd Swan y^e 5^th day of April in the

year of our Lord 1695 at Snow hill within the Jurisdiction of

this Court was indebted unto the sd Robert in the Sum of three hundred

& thirty pounds of tobacco for Credit given the sd Swan by y^e Said

Robert & the tobacco pd unto Ralph Doe, and the sd Swan in manner

afd being indebted unto the sd Robert, did assume upon himSelf &

faithfully promise that he the sd tobacco when thereunto requested

would well & truely Content & pay Nevertheless the sd Swan the said

Sum of 330 pounds of tobacco to the sd Rob^t hath not paid but hath

hitherto refused & doth still refuse although often demanded
