at Wiccocomocoe within the Jurisdiction of this Court ye sd Jno became

indebted unto the sd Lambrook in the just Sum of two thousand five

hundred pounds of tobacco as pr accot here in Court appears and the

Said John being indebted in manner as afd, did upon himSelf assume

& faithfully promise that ye afd Sum of tobo. he would well & truely

content & pay when thereunto required Nevertheless the sd John to

ye sd Lambrook the Same hath not paid although often thereunto

required to the damage of the sd Lambrook of five thousand pounds

of tobacco & thereupon he brings this Sute &ca.         Jno Doe

The Original Writt being returned Non est Inventus, the Decln

being read & ye accot proved, the plts Attorney humbly Craved

an Attachmt might issue agt the goods &ca of the dft wch being

Considered was by the Worll Court granted wth Cost, giving Security

according to Law . whereupon Came the sd Lambrook Thomas wth

his Security Thomas Carey and the sd Securities did pr Recognz

acknowledge themselves to be indebted to the Dft the Sum of

five thousand pounds of tobacco, with Condition that if the sd

absent dft shall come & appear to the Original accon within

a twelvemonth & a day, & make it appear the Debt declared for to

be Satisfied or in part, or otherwayes in barr discount ye Same

that then the sd Securities will be responsible as the Law in Such

Cases doth require // attachmt issued. //

Ephraim Wilson of an accon of the Case – And whereupon the sd

Ephraim by Robert Pirrie his Attorney Saith that whereas the Said

Samuel the 4th day of November in ye year of our Lord 1693 at Manokin

within the Jurisdiction of this Court was indebted to the sd Ephraim

in the Sum of five hundred Sixty eight & a half pounds of tobacco as

pr accot here in Court produced may appear, and the sd Samuel to ye said

in manner afd being indebted did assume upon himSelf and to the

Said Ephraim faithfully promise that he the sd Samuel the said

Sum of tobacco would well & truely content &pay, Nevertheless the

Said Samuel his promise & assumption afd not regarding but

minding & fraudulently intending the sd Ephraim in this —
