and what the sd Vincent had done in relation to her sd Husbands Estate, wherein the members of the Said Convention did adjudge that the Said Vincent had illegally & Surreptiously obtained ye Said letters of Admrn by him Assigned unto the sd George, and further ye Said George by an Order of this Court, delivered unto mr ffra Jenckins the book & papers belonging to the Estate of ye sd Samuel Cooper, Now the Said George in fact Saith that he having pd the Sum of sixteen pound tenn shillings Sterling as afd to the sd Vincent and having recd no Satisfaction for the Same as was promised by ye same Admrn demanded of the sd Vincent in his life time the Sixteen pound tenn Shilling Sterling pd as afd, which he the sd Vincent did faithfully promise to pay unto the sd George when thereunto required Nevertheless the Vincent in his life time the sd Sum of money to the sd George- hath not paid nor ye sd Michael nor James who have Administred upon ye Estate of the sd Vincent but ye Same to doe hath refused though often thereunto required, for which the sd George Saith he is damnified to the value of thirty three pounds of like money & thereupon he brings this Sute &ca. {Jno Doe Worthington pr Quer plegs &ca Rich Roe} The Originall Writt being returned Non est Inventus, ye Decl read, & the sd Layfield made Oath that the fd Sixteen pound tenn shilling he had duely paid to the sd Vincent & that he had received no part or percell of Satisfaction, & therefore humbly Craved an Attachmt agt ye goods &ca of ye sd Vincents in ye hands of ye Admrs, which being Considered was by ye Worll Court granted wth Cost giving Security according to Law whereupon came the sd Layfield & his Security Ephraim Wilson & the sd Layfield & Wilson did pr Recognizance acknowledge themselves to be indebted to ye Admrs of ye sd Vincent Loe in the Sum of thirty three pounds Serling with Condicon that if ye sd Admrs afd doe within a twelve month & a day appear by themselves or their Attorney to ye Original accon & make it appear that the plt is Satisfied his debt, or part thereof or otherwaye in Barr to make discount, that the aforesd Securities will then be responsible as the law in Such Cases doth require. // attachmt issued
