Refused & doth still refuse to pay although often demanded to the damage of the Said William of five thousand pounds of tobacco & thereupon he brings this Sute &ca. Rich Roe } Know all Men by these prsents that I Joseph Staton of the County of Somerset in the Province of Maryland Planter me my Heirs Extors Admrs & Assigns doe owe and stand justly indebted unto William Henderson of the same County & Province afd unto he his Heirs Extors Admrs or Assigns the full & just Sum of two thousand five hundred pounds of good Sound Merchantable tobacco & Caske to be pd at or before the tenth day of October in the year of or Lord God One thousand Six hundd & ninety four at Some Convenient Landing or markett place in Pocomoke River it being for a Valuable Consideracon in hand allready recd as Witness my hand & fixed my Seal this Seventh day of Janry 1692/3. Mr Fra. Jenckins plt Somerset County Ss Griffin Morris dft } Griffin Morris late of Somerset ~ ~ ~ ~ ~ ~ County was Sumoned to answer – unto ffra. Jenckins of ye Same — County Gentl of a plea that he render unto him the Sum of three thousand one hundred eighty Seven pounds of tobacco which to him he oweth & unjustly deteineth &ca. — And whereupon the Said ffra. by Peter Dent his Attorney Complains that whereas the sd Griffin the 31st day of 8ber in the year of our Lord 1690 at Monokin within the Jurisdiction of this Court by his Certain Bond in writeing which the Said ffra. with ye Seal of the sd Griffin Signed brings here into Court the date whereof is the day & year afd acknowledged himself to be indebted to the Said ffra. in ye said Sum of 3187 pounds of tobacco to be pd to the Said ffra. Convenient in the sd County to which paymt well and truely to be made ye sd Griffin bound himself firmly by the sd Bond – Nevertheless, ye sd Griffin ye sd Sum of 3187 pounds of tob. to the sd ffra.according to the tenor of ye sd Bond hath not paid but hath hitherto refused & doth Still refuse to the damage of the sd ffra. of 5000 pounds of tobacco and thereof he brings his Sute &ca. Dent pr Quer Pleg &ca. Jno. Doe Rich Roe }
And the sd Griffin prayes the hearing the Said Bond and it is read unto him he prayes also the hearing the Condicon of ye sd Bond & it is read unto him these words (viz) The Condicon of this prsent Obligation is Such that if the above bounden Griffin Morris his Heirs Extors or Admrs shall well & truely Satisfie Content & pay unto the above Named ffra. Jenckins his Heirs Extrs Admrs or Assigns the just Sum or quantity of one thousand five hundred ninety three & a halfe pounds of good Sound Mertable bright & large tob in Caske Convenient in the County afd that then this prsent Obligation
