To be void & of none effect otherwise to Stand in full force power & Vertue . // Then was produced this following Bond (viz) Maryland Somerset County Ss. Know all Men by these presents that I Griffin Morris of the County afd am holden & firmly bounden unto ffrancis Jenckins of the County afd Gent in ye full & just Sum or Quantity of Three thousand one hundred eighty Seven – pounds of good Sound merchantable tobacco in Caske due to be paid unto ye Said ffrancis Jenckins his Heirs Extors Admrs of Assigns or Lawful Attrny to wch payment well & truely to be made & done I bind myself my Heirs Extors & Admrs firmly by these presents to the sd ffra. his Heirs Extors & Admrs In Witness whereof I have hereunto Sett my hand & Seal this 31 day of October anno Domini 1690 . ~ ~ ~ ~ ~ ~ ~ ~ ~
The Condicon of this prsent Obligacon is Such that if the above bounden Griffin Morris his Heirs Extors of Admrs shall well & truely Satisfie Content & pay unto the above Named ffra Jenckins his Heirs Extors Admrs of Assigns the just Sum or quantity of one thousand five hundred ninety three & a halfe pounds of good Sound merchantable bright and large tobacco in Caske Convenient in the County aft that then this prsent Obligation to be void & of none effect otherwise to stand in full force power & vertue . // his Sealed & delivered in Griffin ❂ Morris ❂ prsence of us – marke Isabel Davison her marke Jno Vigerous // The Original Writt being returned Non est Inventus the prmises Considered this Court doe Order an Attachmt to issue agt the goods &ca. of the Said Morris he ye sd Jenckins first giving Security according to Law.
Mr James Round Plt Somerset County Ss. Griffin Morris Dft } Griffin Morris late of this County was – – – – – – – – attached to answer unto James Round Gentl of a plea of Trespas on ye Case &ca. ____ And whereupon the sd James by Peter Dent his Attorney Complains that whereas the sd Griffin ye 14th day of June in the year of or Lord 1695. at Monocan within the Jurisdiction of this Court was indebted to the sd James in the Sum of one hundred Seventy nine pounds of Porke & Eight hundred & eighty & one half pound of tobacco being the ballance of a Certain accot for Sundry goods & Merchandizes Sold & delivered as by accot here in Court may appear & the sd Griffin to the sd James in manner afd being indebted did assume on himself & to the sd James faithfully promise that he the sd Griffin the Same to the sd James would well & truely [content] & pay Nevertheless the sd Griffin his prmise & assumption afd not regarding but minding & fraudulently intending the sd James in this behalfe to deceive & defraud the Same to the sd James hath not paid but hath hitherto refused & doth Still refuse to the damage of the Said James of two thousand pounds of tobaco & thereof he brings his Sute.
