horse riding AND BOARDING RENTAL stables AND SALES
BARNS, creating a board of inspection, providing for the appoint-
ment of its members, their compensation, powers, and duties and
providing for penalties for violations of this section, and generally
relating to the licensing of horse riding stables.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 128 to 130E D, inclusive, be and they are hereby
added to Article 56 of the Annotated Code of Maryland (1964 Re-
placement Volume and 1967 Supplement), title "Licenses," to follow
immediately after Section 127 thereof and to be under the new sub-
title "Horse Riding Stables," and to read as follows:
Horse Riding AND BOARDING RENTAL Stables
128. Definition of terms
The following words and phrases when used in this section shall
be construed as follows:
(1) "Person" shall include any individual, firm, co-partnership,
association or corporation.
(2) "Horse Riding AND BOARDING RENTAL Stables" shall
mean any establishment in connection with which one or more horses
or ponies are BOARDED OR let for hire to be ridden or driven, either
with or without the furnishing of riding or driving instruction.
(3) "Horse" shall include both horses and ponies.
(4) "SALES BARNS" SHALL INCLUDE ALL ESTABLISH-
MENTS WHERE HORSES ARE SOLD. ALL REFERENCES
TO HORSE RIDING AND BOARDING STABLES SHALL
ALSO APPLY TO SALES BARNS.
129.
No person shall engage in the business of operating or main-
taining any horse riding stable unless such person shall have re-
ceived a license and a certificate therefor issued by the State Board
of Inspection of Horse Riding Stables.
130.
There is hereby created a State Board of Inspection of Horse
Riding Stables to consist of three (3) members to be appointed by the
Governor for four year terms, one member shall be a duly qualified
and licensed veterinarian and one member shall be an officer of a
County Humane Society. The members of the Board shall select
their Chairman. All the members of the Board shall serve without
compensation but shall be allowed their actual expenses incurred
in the performance of their duties, to the extent monies are avail-
able out of the license fees collected under the provisions of Section
130B, it being the intent of the General Assembly that the operations
shall be self-sustaining and that no general funds of the State shall
be applied.
