Section 1. Be it enacted by the General Assembly of Maryland,
That Section 47 of Article 88B of the Annotated Code of Maryland
(1964 Replacement Volume), title "State Police," subtitle "Central
Accident Records Bureau," be and it is hereby repealed and re-
enacted, with amendments, to read as follows:
47.
The Superintendent of State Police is directed to make available
to the executive officer of any agency of the State or subdivision
thereof, for the purpose of study, such files, records, and reports
as he has which relate to traffic accidents or other causes; and the
executive officers of such agencies are directed to extend the same
facilities to the Central Accident Records Bureau. The said Central
Accident Records Bureau shall furnish upon request copies of reports,
statements, plats and photographs, relating to any accident to all
persons PARTIES IN INTEREST making such request and may
charge a fee of one dollar ($1.00) to all persons other than an agency
of the State or any subdivisions thereof for furnishing a copy of
the report relating to any accident and a fee of twenty-five cents
(25¢) for searching its files and producing an accident report on
application of any person wishing to make copy of same. The Central
Accident Records Bureau shall provide duplicating facilities for peo-
ple wishing to make copies of any accident report and the fee they
may charge for use of the duplicating facilities may not be greater
than five dollars ($5.00). In the absence of pending prosecution or
upon termination of any prosecution with respect to any traffic
accident, the said Central Accident Records Bureau may furnish a
print of any photograph relating to such accident to any person
other than an agency of the State or any subdivision thereof, and
may charge a fee of one dollar ($1.00) per print A REASONABLE
FEE SET BY THE SUPERINTENDENT OF STATE POLICE
TO COVER THE COST OF FURNISHING SUCH COPIES,
PROVIDED THAT WHEN THE ACCIDENT TO WHICH SUCH
COPIES RELATE IS THE SUBJECT OF A PENDING CRIM-
INAL PROSECUTION BY THE STATE, THE CENTRAL AC-
CIDENT RECORDS BUREAU MAY NOT FURNISH SUCH
COPIES WITHOUT THE CONSENT OF THE STATE'S AT-
TORNEY HAVING JURISDICTION OVER THE PROSECU-
TION OR UPON COURT ORDER.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
