(3) Whether or not the 'particular structure or tree will create or
become an airport hazard; and

(4) Whether or not the issuance of such permit will result in
endangering the public health, safety, security or order.

(l) Same; appeals. Any and all appeals which may be taken
from any decision of the Board of Airport Zoning Appeals to a
court of record as indicated in Section 16 of Article 1A of the Anno-
tated Code of Maryland shall be filed in the Baltimore City Court
located in Baltimore, Maryland, or in the Circuit Court for Anne
Arundel County, located in Annapolis, Maryland, and the Maryland
Airport Authority shall have the right to take an appeal from any
decision of the Board of Airport Zoning Appeals in the manner indi-
cated in Section 16 of said Article 1A.

(m) Same; effect of regulations. Any and all airport zoning reg-
ulations adopted or promulgated under the power and authority con-
tained in Section 16 of Article 1A of the Annotated Code of Maryland
or in this section shall be reasonable and shall have full force of
law, and none shall require the removal, lowering or other change or
alteration of any structure or tree not conforming to airport zoning
regulations when adopted or revised, or otherwise interfere with the
continuance of any non-conforming use.

(n) Definitions. Unless the context otherwise requires, the fol-
lowing words or phrases shall have the meaning set opposite them
for any and all purposes of this ordinance:

(1)  "Airport" means any area of land or water, or both, designed
or set aside for the landing and taking off of aircraft located, in
whole or in part, in Anne Arundel County and owned by the Mary-
land Airport Authority.

(2)  "Airport Hazard" means any structure, tree or use of land
which interferes with communication between am, airport and air-
craft approaching or leaving the same or which obstructs the aerial
approaches of an airport or which is otherwise hazardous to its use
for landing or taking off of aircraft;

(3)  "Aircraft" means and includes balloon, airplane, hydroplane,
glider and every other vehicle used for navigation through the air;

(4) "Landing Area" means the area of an airport used for the
landing, taking off and taxiing of aircraft;

(5)  "Non-conforming" means that which does not conform to
any airport zoning regulation or rule, or any amendment thereto,
as of the effective date of such regulation, rule or amendment;

(6)  "Person" means any individual, firm, copartnership, corpora-
tion, company, association, joint stock association or body politic,
and includes any trustee, receiver, committee, assignee or other
similar representative thereof;

(7)  "Structure" means any object or thing constructed, erected,
placed or installed above, the surface of the ground, including, but
without limitation, buildings, fences, derricks, haystacks, poles, wires,
towers and smokestacks;
