(j) Board of Airport Zoning Appeals.
(1) Created. There shall be a Board of Airport Zoning Appeals
which shall have and exercise all of the powers contained in Section
16 of Article 1A, Annotated Code of Maryland.
(2) Members. The said Board of Airport Zoning Appeals shall
consist of five (5) members who shall be appointed by the said Air-
port Zoning Board in the manner provided in Section 16 of the afore-
said Article 1A, and said Board of Airport Zoning Appeals shall be
subject to and shall comply with, all of the applicable terms and
provisions contained in said Article and this subtitle.
(3) Qualifications. Three (3) members of said Board of Airport
Zoning Appeals shall be residents of Anne Arundel County and the
other two members of said Board shall be residents of the City of
Baltimore. The Chairman of said Board shall be designated by the
Airport Zoning Board. Vacancies on- said Board shall be filled in the
same manner as original members are appointed for the unexpired
term of any member whose term becomes vacant and any member
of said Board shall serve until his successor takes office.
(4) Employees; staff. The said Board of Zoning Appeals is
hereby authorized to appoint a Secretary of said Board and such
other assistants and employees as may be necessary for the proper
performance of the duties and business of said Board and all of said
appointments shall be 'made pursuant to the laws, rules and regula-
tions pertaining to or issued by the Maryland Airport Authority. The
Authority shall furnish adequate office space for the proper func-
tioning of said Board of Airport Zoning Appeals. The Chairman and
all other members of said Board, as well as the said Secretary and
all assistants and employees shall receive such compensation as may
be authorized for such purpose by the Maryland Airport Authority.
(k) Same; powers. The Board of Airport Zoning Appeals, cre-
ated in accordance with the provisions of Section 16 of Article 1A,
Annotated Code of Maryland, is hereby authorized and empowered
to hear, decide and grant specific variances from airport zoning
regulations in cases of practical difficulty or unnecessary hardship
after public notice has been given and a hearing held in connection
therewith. Any person desiring to erect any structure or increase
the height of any structure, or permit the growth of any tree, or
otherwise use his property, in violation of any airport zoning regu-
lation, may make application in the manner provided in Section (i)
hereof for a variance from the airport zoning regulations in question.
In all applications for variance permits arising under said Section
(i) the Board of Airport Zoning Appeals shall act as a fact finding
body and as a guide to its decision shall give consideration, among
other things, to the rules, regulations, restrictions, guides and stand-
ards set forth in the said Article, in this subtitle and in the airport
zoning rules and regulations, and especially to the following:
(1) The guides and standards set forth in Section (d) of this
section;
(2) The height and width or proposed height and width and use
or proposed use of the particular structure or tree in connection with
which a variance from the airport zoning regulations is being
requested;
