BE PURCHASED BY SUCH SPECIAL LICENSE HOLDER FROM
RETAIL DEALERS. IN BALTIMORE COUNTY AND CALVERT
COUNTY THE FEE FOR SUCH A LICENSE SHALL BE
TWENTY-FIVE DOLLARS ($25.00) PER DAY, EXCEPT THAT
FOR ANY BONA FIDE RELIGIOUS, FRATERNAL, CIVIC, WAR
VETERANS', HOSPITAL OR CHARITABLE ORGANIZATION,
THE FEE FOR SUCH A LICENSE SHALL BE FIFTEEN DOL-
LARS ($15.00).

SEC. 3. AND BE IT FURTHER ENACTED, THAT SECTION
37(C) OF ARTICLE 2B OF THE ANNOTATED CODE OF MARY-
LAND, (1957 EDITION AND 1967 SUPPLEMENT), AS THAT
SECTION WAS LAST AMENDED BY CHAPTER 750 OF THE
LAWS OF MARYLAND, 1967, TITLE "ALCOHOLIC BEVER-
AGES" SUBTITLE "LOCAL LICENSES AND LICENSE PROVI-
SIONS," BE AND IT IS HEREBY REPEALED AND NEW SEC-
TION 37(C) BE ADDED TO ARTICLE 2B, AND READ AS
FOLLOWS:

39.

(C) (1) IN MONTGOMERY COUNTY IT IS UNLAWFUL
FOR ANY PERSON, CORPORATION, CLUB OR ORGANIZATION
TO SELL, GIVE, SERVE, DISPENSE, KEEP OR ALLOW TO BE
CONSUMED ON HIS OR ITS PREMISES OR ON PREMISES
UNDER HIS OR ITS POSSESSION OR CONTROL ANY ALCO-
HOLIC BEVERAGES OTHER THAN AS SPECIFICALLY PER-
MITTED OR PROVIDED IN THIS ARTICLE IF THESE PREM-
ISES CONSTITUTE A RESTAURANT, TAVERN, HOTEL, CLUB,
PLACE OF PUBLIC ENTERTAINMENT, OR PREMISE OPEN
TO THE PUBLIC OR ON PREMISES IN ANY WAY LICENSED
IN ANY MANNER BY THE STATE OF MARYLAND OR MONT-
GOMERY COUNTY.

(2)    AS USED IN THIS SECTION, THE TERM "BOTTLE
CLUB" SHALL MEAN ANY CLUB WHICH SERVES, SELLS,
GIVES OR DISPENSES ALCOHOLIC BEVERAGES TO ITS
MEMBERS OR GUESTS, OR WHICH KEEPS FOR ITS MEMBERS
OR GUESTS ANY ALCOHOLIC BEVERAGES, OR WHICH AL-
LOWS TO BE CONSUMED ON ITS PREMISES ANY ALCOHOLIC
BEVERAGES, BY ITS MEMBERS OR GUESTS, WHICH BEVER-
AGES HAVE BEEN RESERVED OR PURCHASED BY THE
MEMBERS OR GUESTS; OR ANY CLUB AT WHICH PATRONS
ARE SERVED, GIVEN, OR ALLOWED TO CONSUME ALCO-
HOLIC BEVERAGES AFTER LEGAL CLOSING HOURS FROM
THE SUPPLIES THAT THE PATRONS HAVE PREVIOUSLY
PURCHASED OR RESERVED; OR ANY CLUB THAT SELLS,
DISPENSES, SERVES, KEEPS, OR ALLOWS TO BE CONSUMED
ANY SET-UPS OR OTHER COMPONENT PARTS OF MIXED
ALCOHOLIC DRINKS TO ITS MEMBERS OR GUESTS.

(3)    IT SHALL BE UNLAWFUL IN MONTGOMERY COUNTY
FOR ANY "BOTTLE CLUB" AS HEREIN DEFINED OR OTHER
PUBLIC CLUB, ROOM, OR PREMISES WHICH IS TO BE USED
OR IS USED AS A "BOTTLE CLUB" SO AS TO EVADE THE AL-
COHOLIC BEVERAGE LICENSE LAWS OR HOURS OF OPERA-
TION, TO SELL, GIVE, SERVE, DISPENSE, KEEP OR ALLOW
