County; or on the shore of any landing, dock or harbor, below high
water mark, unless for the making or improvement of a wharf. Any
person violating the provisions of this section shall be fined not more
than two hundred and fifty dollars ($250.00).

(B) NOTHING HEREIN IS TO BE CONSTRUED TO BE
APPLICABLE TO ANY SANITARY PLANT OR OPERATION
WHICH HAS BEEN APPROVED BY THE STATE DEPART-
MENT OF HEALTH.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.

CHAPTER 332
(House Bill 908)

AN ACT to add new Section 46(d) to Article 2B of the Annotated
Code of Maryland (1957 Edition and 1967 Cumulative Supple-
ment), title "Alcoholic Beverages," subtitle "General Provisions
on Issue of Licenses," to follow immediately after Section 46(c)
thereof, invalidating renewals and transfers of alcoholic beverage
licenses in Anne Arundel County unless the owner or owners of
such license have actively engaged in the sale of alcoholic bev-
erages as authorized by such license within one (1) year prior to
the date of application for such renewal and/or transfer; and
matters generally related thereto.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That new Section 46(d) be and it is hereby added to Article 2B of
the Annotated Code of Maryland (1957 Edition and 1967 Cumulative
Supplement), title "Alcoholic Beverages," subtitle "General Provi-
sions on Issue of Licenses," to follow immediately after Section 46 (c)
thereof, and to read as follows:

46.

(d) No alcoholic beverage license in Anne Arundel County may
be renewed and/or transferred unless the owner or owners thereof
have actively engaged in the sale of alcoholic beverages as author-
ized by said license within one year prior to the date of application
for said renewal and/or transfer; and any such attempted renewal
and/or transfer of such a dormant license not in accordance with
the provisions of this section shall be null and void and of no effect.
THE RE-ISSUANCE OF ANY LICENSE TO ANY LICENSEE
WHOSE LICENSE HAS BEEN NON-RENEWED UNDER THE
PROVISIONS OF THIS SECTION SHALL BE SUBJECT TO THE
HEARING, NOTICE AND OTHER PROVISIONS OF SECTION
60 OF THIS ARTICLE.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
