of pension rights of judges and former judges of Orphans' Court
of Baltimore City, after January 1, 1971, and matters generally
related thereto.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 255(p) of Article 93 of the Annotated Code of Maryland
(1964 Replacement Volume and 1967 Cumulative Supplement),
title "Testamentary Law," subtitle "Orphans' Court," be and it is
hereby repealed and re-enacted, with amendments, to read as follows:
255.
(p) (1) The salary of each of the associate judges of the
Orphans' Court of Baltimore City shall be fourteen thousand dollars
($14,000,) per annum, and the salary of the chief judge of the
Orphans' Court of Baltimore City shall be fourteen thousand five
hundred dollars ($14,500.) per annum. Every associate judge of the
Orphans' Court of Baltimore City shall be paid, after the termina-
tion of active service, if he is then at least 60 years of age or when
he shall attain 60 years of age, a pension or salary calculated at
the rate of seven hundred dollars ($700) per annum for each year,
or any part thereof, of active service, but the maximum pension or
salary for such service shall not exceed seven thousand dollars
($7,000.) per annum. Every chief judge of the Orphans' Court of
Baltimore City shall be paid, after the termination of- active service,
if he is then at least 60 years of age or when he shall attain 60 years
of age, a pension or salary calculated at the rate of seven hundred
and twenty-five dollars ($725.) per annum for each year, or any part
thereof, of active service, but the maximum pension or salary for
such service shall not exceed seven thousand, two hundred and fifty
dollars ($7,250) per annum. The said pension or salary shall be paid
by the City of Baltimore in the same manner as the salaries of the
judges of the Orphans' Court of said city are paid.
(2) AM NOTWITHSTANDING ANY PROVISIONS TO THE
CONTRARY IN SECTION 21(b) OF THE SCHEDULE OF
LEGISLATION ADOPTED BY THE 1967 MARYLAND CON-
STITUTIONAL CONVENTION, ALL judges and former judges
of the Orphans' Court of Baltimore City who have earned pension
rights during their tenure of office shall retain such rights after Jan-
uary 1, 1971 DECEMBER 31, 1970, and shall be entitled to their
pensions subject to all the terms and conditions existing under the
laws in effect as of January , 1971 PRIOR TO THE ADOPTION
OF THE PROPOSED CONSTITUTION TRANSITIONAL PROVI-
SIONS AND SCHEDULE OF LEGISLATION.
Sec. 2. And be it further enacted, That if the proposed Constitu-
tion is adopted by the voters in the election to be held on May 14,
1968, this Act shall take effect July 1, 1968.
