CHAPTER 173
(House Bill 17)

AN ACT to repeal and re-enact, with amendments, Sections 2(b),
5(a), 5(f), 5(i), 6(b)(6), 12(c), and 14(n) of Article 64B of the
Annotated Code of Maryland (1964 Replacement Volume and 1967
Supplement), title "Metropolitan Transit Authority," relating
generally to the Metropolitan Transit Authority, and to the ap-
pointment, powers, duties, functions, and operations of certain
members of the Authority, and correcting an error in said Section
5(f) thereof.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 2(b), 5(a), 5(f), 5(i), 6(b)(6), 12(c), and 14(n)
of Article 64B of the Annotated Code of Maryland (1964 Replace-
ment Volume and 1967 Supplement), title "Metropolitan Transit
Authority," be and they are hereby repealed and re-enacted, with
amendments, to read as follows:

(b) The word "area" means all of the territory located within
the boundary lines of Baltimore City and Baltimore County with the
exception of the fifth, sixth, seventh and tenth election districts of
Baltimore County, [and the third and fifth elections districts of
Anne Arundel County and that portion of the fourth election] and
the 1st, 2nd, 3rd and 5th Councilmanic Districts of Anne Arundel
County and that portion of the 4th Councilmanic
district of the
county lying north and east of State Highway No. 175.

(a) Appointment of members. The Authority consists of seven
members who shall be appointed as follows: The Governor shall
appoint one member who resides in the metropolitan area, as de-
fined by this article, [If the Governor's appointee is a resident of
Baltimore City, then the successor to such appointee shall be a
resident of Baltimore County, and vice versa.] IF THE APPOIN-
TEE IS A RESIDENT OF BALTIMORE COUNTY THEN THE
SUCCESSOR SHALL BE A RESIDENT OF ANNE ARUNDEL
COUNTY AND IF THE APPOINTEE IS A RESIDENT OF
ANNE ARUNDEL COUNTY, THEN THE SUCCESSOR SHALL
BE A RESIDENT OF BALTIMORE CITY. The mayor of Balti-
more shall appoint two of the members, both of whom shall be
residents of Baltimore City, subject to the approval of the City
Council of Baltimore; the County Council of Baltimore County shall
appoint two of the members, both of whom shall be residents of
Baltimore County. Two members who are residents of that portion
of Anne Arundel County referred to in Section 2(b) of this article
shall be appointed by [a committee consisting of the State Senator
from the county and the members of the House of Delegates elected
from the county and the members of the Board of County Com-
missioners of the county from the election districts referred to in
Section 2(b)] the County Executive. [The members selected from
Anne Arundel County in addition to the qualifications provided in
subsection (b) below, shall be persons who are prominent members
