diate preservation of the public health and safety and having been
passed by a yea and nay vote supported by three-fifths of all the
members elected to each of the two Houses of the General Assembly,
the same shall take effect from the date of its passage.

CHAPTER 166
(Senate Bill 673)

AN ACT to repeal Section 40 (n) of Article 10 of the Annotated
Code of Maryland (1957 Edition and 1967 Supplement), title
"Attorneys at Law and Attorneys in Fact," subtitle "State's
Attorney," and to enact new Section 40 (n) to stand in the place
of the section repealed, to provide for the salary of the State's
attorney in Howard County, the deputy State's attorney and
assistant State's attorneys, administrative assistant, their salaries
and duties.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 40 (n) of Article 10 of the Annotated Code of Mary-
land (1957 Edition and 1967 Supplement), title "Attorneys at Law
and Attorneys in Fact," subtitle "State's Attorney," be and it is
hereby repealed, and new Section 40 (n) be and it is hereby enacted
to stand in the place of the section so repealed, and to read as
follows:

40.

(n) (1) The State's Attorney's salary is $8,500.00.

(2)   The State's Attorney may appoint a deputy State's Attorney,
whose salary shall be set by the Board of County Commissioners of
Howard County, but not less than $6,000.00 annually.

(3)   The State's Attorney may appoint such assistant State's At-
torneys as may be authorized by the Board of County Commissioners
and whose salaries shall be set by the Board of County Commis-
sioners. The Deputy and Assistant State's Attorneys shall serve at
the pleasure of the State's Attorney and have the same legal power
as the State's Attorney to represent the State before the Grand Jury
and at the trial of criminal proceedings.

(4) The State's Attorney may appoint an Administrative Assist-
ant who is authorized and empowered to collect and distribute
monies payable for the support of dependents under orders issuing
from the several courts of this State, or any other state, and to
retain two percent of any monies so collected to be paid to the Board
of County Commissioners for Howard County to defray the costs of
this service.
THE ADMINISTRATIVE ASSISTANT'S SALARY
SHALL BE SET BY THE BOARD OF COUNTY COMMIS-
SIONERS.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
