1602                             JOINT RESOLUTIONS

Resolved, That the heads of the various departments and agencies
should be advised that the General Assembly, through its legislative
Council, may require them to bring to committee hearings a copy of
all publications issued during the current fiscal year to report on,
and explain the need for, each publication; and be it further

Resolved, That copies of this Resolution be sent to the Governor
of Maryland to advise him that this action has been taken; and be
it further

Resolved, That copies of this Resolution be sent to the heads of
the various departments and agencies of the State.

(House Joint Resolution 4)

House Joint Resolution requesting the Rules Committee of the Court
of Appeals to study possibilities for a proposed rule covering the
Service of Process on the United States.

Whereas, The Committee of State officials on suggested State
legislation of the Council of State Governments has proposed a
statute covering the Service of Process on the United States.

This statute has been submitted to the consideration of the sev-
eral states in order to clarify and make certain the proper method
for service on the United States when suit is entered in a State
court.

The suggested statute is very similar to what has already been
provided in the Federal rules of civil procedure when suit against
the United States is entered in a Federal court.

The Committee on Intergovernmental Cooperation of the Legis-
lative Council and of the General Assembly in considering this
subject noted that it is covered by rule for suits in Federal court
and has suggested the possibility that if such a provision is adopted
in the State of Maryland, it might also be covered by rule rather
than statute.

Accordingly, this Committee is requesting that the Rules Com-
mittee of the Court of Appeals of Maryland study the proposed
statute covering the Service of Process on the United States in
state courts to determine if this subject matter should be covered
by rule; now therefore, be it

Resolved by the General Assembly of Maryland, That the Com-
mittee on Rules of the Court of Appeals of Maryland is requested
to consider the proposed statute "Service of Process on the United
States" as contained in the 1968 Volume of Suggested State Legis-
lation published by the Council of State Governments; and be it
further
