(2) is able to read, write, speak and understand the English
language; and
(3) is free of any mental or physical infirmity, or any other
incapacity which renders him unfit for service as a juror; and
(4) has no criminal charge pending against him, and no record
of conviction in a State or Federal Court of a felony or a mis-
demeanor punishable by a term of imprisonment; or if so convicted,
whose civil rights have been restored by pardon or amnesty.
(b) In considering persons for jury service, the Jury Commis-
sioner shall exclude those exempt under the Public General Laws of
Maryland; and, in accordance with Rules of the Supreme Bench, may
excuse any others from jury service or defer such service for good
cause shown.
386. Procurement and Selection of Jurors
(a) At least once each year, in accordance with the indicated
need for additional prospective jurors, the Jury Commissioner shall
list the names of any registered voters who may have volunteered for
initial jury service, and add thereto a sufficient number of names
obtained from the voter registration list of Baltimore City or from
other sources in accordance with Section 382(c), (d) of this subtitle.
(b) All persons initially considered for jury service, together
with former jurors eligible for reconsideration, shall be examined
as to their qualifications; and the names of all persons found qualified
for such service shall be filed with reference to the legislative dis-
trict in which the qualified person lives, and by the month or
months in which he is available for service including his availability
to serve for a four month period as a grand juror.
(c) No person shall be subject to compulsory jury service within
the three years following the completion of a period of service as a
grand or petit juror; though any former juror may be considered
for further service after a period of one year.
(d) From the file of qualified jurors, as provided in subsection
(b) above, the Supreme Bench shall select, on an approximately
proportional basis from each legislative district, the persons to serve
as grand jurors for each term of court; and each such grand jury,
shall insofar as is possible, represent a fair cross-section of Balti-
more City. The Judges of the Criminal Court shall designate a fore-
man and assistant foreman from among the members of each grand
jury.
(e) At such times as the Supreme Bench shall determine by
appropriate Rule, the Jury Commissioner shall place in a drawing
wheel the names of not less than six hundred qualified jurors drawn
equally from each of the six legislative districts of Baltimore City;
and from this wheel the Jury Judge shall draw at random the names
of the persons to serve as petit jurors in the several courts of the
Supreme Bench. The names placed in the drawing wheel shall be
taken uniformly and proportionally from the entire list of quali-
fied jurors from each district who are available for service within
the period for which juries are to be selected.
