direct ad valorem tax not exceeding 1¢ per $100.00 on all property
assessed for tax purposes within said County and municipalities
THEREIN, with the exception of that portion of the City of Takoma
Park now situated in Montgomery County, necessary to pay the sums
required for the maintenance of storm drainage systems within that
portion of the Sanitary District lying within Montgomery County,
and heretofore maintained by the Commission. On and after June
30, 1968, EXCEPT AS OTHERWISE PROVIDED HEREIN,
but in any event prior to the date upon which the County
Council adopts its annual budget and appropriations resolution,
should any municipality, IN MONTGOMERY COUNTY, desire
to maintain all present THEN EXISTING storm drainage sys-
tems located within its boundaries, it may so notify the Council,
and in such event, assessable properties located within its boundaries
shall become exempt from the levy made by the Council for the future
maintenance of its storm drainage. On or before June 30, 1968, the
Washington Suburban Sanitary Commission shall by deed, transfer to
Montgomery County any and all interests it may have in surface
drainage easements, structures and other properties, established by
plat or otherwise for storm drainage use and purposes, located so as to
provide for the control and disposition of strom STORM and surface
waters in Montgomery County, except for the aforesaid portion of the
City of Takoma Park; and provided further, that said Commission will
permit the necessary ingress and egress over any of its fees, lease-
holds, easements, or rights-of-way which may be required in order
that the County Council of Montgomery County can perform such
maintenance.

The Commission, OR AFTER JUNE 30, 1968 IN MONT-
GOMERY COUNTY, EXCEPT FOR THAT PORTION OF THE
CITY OF TAKOMA PARK NOW SITUATED IN MONTGOMERY
COUNTY, THE COUNTY COUNCIL, may require any owner or
developer of a subdivision or tract of land upon which dwellings,
apartments, stores or other buildings, are to be erected to contribute
what it deems to be a fair share of the cost of a drainage project
before it approves or constructs such project, such contribution to
be paid in cash before construction begins or secured to the satis-
faction of the Commission; and said Commission may construct any
part of any approved drainage project, provided the person or com-
pany interested contributes not less than one-half of the cost thereof
[.] ; provided, however, that on and after June 30, 1968 EXCEPT
AS OTHERWISE PROVIDED HEREIN, this section shall not apply
in Montgomery County, except for WITH THE EXCEPTION OF
that portion of the City of Takoma Park now situated in Montgom-
ery County. AFTER JUNE 30, 1968 IN MONTGOMERY COUNTY,
EXCEPT FOR THAT PORTION OF THE CITY OF TAKOMA
PARK NOW SITUATED IN MONTGOMERY COUNTY, THE
SAID COUNTY MAY CONSTRUCT ANY PART OF ANY
APPROVED DRAINAGE PROJECT, PROVIDED THE PER-
SON OR COMPANY INTERESTED CONTRIBUTES SUCH
SHARE OF THE COST THEREOF AS IS DEEMED PROPER
BY SAID COUNTY. IN MONTGOMERY COUNTY THE DI-
RECTOR OF THE DEPARTMENT OF PUBLIC WORKS SHALL
INCLUDE IN HIS ANNUAL SUBMISSION TO THE COUNTY
MANAGER OF HIS ESTIMATES OF CAPITAL PROJECTS
