TO BE UNDERTAKEN, A REQUEST FOR AN APPROPRIA-
TION TO PROVIDE SUFFICIENT FUNDS FOR ANTICI-
PATED CONTRIBUTION DRAINAGE PROJECTS.

83-92. (71-41.)

(b) Approval of drainage system. No drainage plan, system or
design shall be adopted, or any drainage system constructed, except
for the protection of an individual's home, by any person, firm, cor-
poration or muncipality, unless such plan or design has been approved
by the Washington Suburban Sanitary Commission [.]; provided
that on and after June 30, 1968, this section shall not apply in Mont-
gomery County,
IN MONTGOMERY COUNTY, EXCEPT FOR
THAT PORTION OF THE CITY OF TAKOMA PARK NOW
SITUATED IN MONTGOMERY COUNTY, SUCH APPROVAL
SHALL BE BY MONTGOMERY COUNTY AND NOT THE WASH-
INGTON SUBURBAN SANITARY COMMISSION except for that
portion of the City of Takoma Park now situated in Montgomery
County.
; PROVIDED, HOWEVER, THAT WHENEVER THE
COUNTY PREPARES A PLAN, SYSTEM OR DESIGN, OR
WHENEVER A PLAN, SYSTEM OR DESIGN HAS BEEN
SUBMITTED TO THE COUNTY, THE COUNTY SHALL CAUSE
A COPY OF THE SAME TO BE SUBMITTED TO THE COM-
MISSION WHICH SHALL HAVE A SPECIFIED REASON-
ABLE TIME TO REVIEW AND COMMENT THEREON TO
MONTGOMERY COUNTY TO INDICATE ANY AND ALL CON-
FLICTS IN SAID PLAN, SYSTEM OR DESIGN WITH THE
COMMISSION'S EXISTING OR PLANNED WATER SUPPLY
OR SANITARY SEWER SYSTEMS AND THE APPROVAL
BY MONTGOMERY COUNTY SHALL AVOID ANY OF THE
CONFLICTS IDENTIFIED BY THE COMMISSION.

After June 1, 1953, whenever a muncipality or the property owners
or residents of any locality in the Sanitary District shall desire a
water supply, sewerage or drainage system, or part thereof, to be
constructed in that muncipality or locality, and the Commission shall
decide that it is inexpedient or impracticable at the time, owing to
remoteness from its general system or other cause, to build such
system, such municipality or persons may build and operate said
system at its or their own expense, but it shall be constructed under
plans and specifications submitted to and approved by said Commis-
sion and its construction, maintenance and operation shall be under
the supervision and general control of said commission; and no
such system or part thereof, or no water main, sewer, storm-water
drain, water purification or sewage disposal plant, or no connection
with the above, shall be constructed or installed except as above
provided, and any violation of this provision shall be a misdemeanor
punishable under Section 83-108 (71-58 of this Code) of this sub-
title. All construction and operating records, including cost records,
shall be filed with the Commission, which shall be empowered at any
time to take over said system or part thereof, or said water main,
sewer, storm-water drain, water purification or sewerage disposal
plant, or connection with the above, in the same manner as provided
in Section 83-94 (71-43 of this Code) for systems existing at the
time of the passage of this subtitle (that section). The Commission
