provided however, that on and after June 30, 1968 EXCEPT AS
OTHERWISE PROVIDED HEREIN the Commission shall restrict
such
DRAINAGE SYSTEM activities relating to drainage systems
and districts to Prince George's County and the City of Takoma
Park.

That said Commission may thereafter proceed with such con-
struction in any of said districts as in its judgment it deems ad-
visable, but that wherever such construction is upon the motion of the
Commission without petition or request from any part PARTY inter-
ested, said Commission may give such reasonable notice as it deems
advisable [.]; provided that on and after June 30,1968 EXCEPT AS
OTHERWISE PROVIDED HEREIN, the above section insofar as it
applies to the power and authority granted to the Washington Subur-
ban Sanitary Commission over drainage systems is not applicable in
Montgomery County, with the exception of that portion of the City
of Takoma Park now situated in Montgomery County.

The Washington Suburban Sanitary Commission is hereby author-
ized, when in its judgment it is deemed expedient or necessary to plan,
design, construct, maintain, and operate a system for the control
and disposition of surface waters within the limits of the Washing-
ton Suburban Sanitary District, and for such purpose, said Com-
mission is given all of the power and authority, including the right
to condemn, heretofore given it by law, in the construction and
operation of its water and sewer system, and the right and authority
to negotiate with any public agency and to make contracts with such
agency, including the Government of the United States or any bureau
or department thereof[.]; provided that on and after June 30, 1968
EXCEPT AS OTHERWISE PROVIDED HEREIN, above provi-
sions shall not apply in Montgomery County, with the exception of
that portion of the City of Takoma Park now situated in Montgomery
County.

83-86. (71-36.)

The said Commission may determine, upon petition, or its own
motion that one or more areas in the Sanitary District, in the interest
of the public health, welfare and safety is in need of a storm water or
surface water drainage system. After having made said determina-
tion, the Commission shall advertise in not less than two issues
in any newspaper published in the county in which said drainage
area lies, that the Commission has determined to construct in the
area determined upon, or a part thereof, a drainage system, giving
in said advertisement the approximate cost and the general area
affected, and advising those interested that a hearing will be held
by the Commission at a time and place named in said advertisment
at which all interested parties will be heard. The Commission
shall be prepared to exhibit at such hearing a plan for said drain-
age area or a part thereof, including the length and size of pipe
and the approximate cost. If, after such hearing, the Commission
determines that the public health and welfare requires the con-
struction of said system, it shall thereupon proceed with such con-
struction, either by contract, publicly advertised or by its own
force, or under its own supervision as it deems desirable and more
economical [.]; provided that on and after June 30, 1968, EXCEPT
