Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 36A 394A be and it is hereby added to Article 43 of
the Annotated Code of Maryland (1965 Replacement Volume), title
"Health," subtitle "Miscellaneous Provisions," "WATER, ICE AND
SEWERAGE," to follow immediately after Section 36 394 thereof,
and to read as follows:
36A. 394A.
Before granting permission for any deposit of unwholesome or
noxious matter on any of the land or water areas of this State, the
State Board of Health or the local board of health BEFORE ISSUING
A PERMIT FOR A LANDFILL REFUSE DISPOSAL SYSTEM
UNDER SECTION 394, ARTICLE 43 OF THE ANNOTATED
CODE OF MARYLAND, THE STATE DEPARTMENT OF
HEALTH shall set a day for a public hearing on the request. The
applicant for permission to deposit the unwholesome or noxious mat-
ter shall give notice to the public of his application and of the hearing,
by publication once in each week for two successive weeks prior to
the hearing, in a daily newspaper published or distributed REGU-
LARLY PUBLISHED NEWSPAPER OF GENERAL CIRCULA-
TION in any city or county which the Board DEPARTMENT of
Health determines may be directly affected by the request. The
Board of County Commissioners or the County Council of the county,
the mayor or other chief executive official of each such municipal cor-
poration, THE MARYLAND GEOLOGICAL SURVEY, AND THE
DEPARTMENT OF WATER RESOURCES and the proper officials
of any interested agency of the State or political subdivision thereof
also shall be notified by the applicant by registered or certified mail.
THE LOCAL OFFICIALS SHALL NOTIFY ALL INTERESTED
AGENCIES OF THEIR POLITICAL SUBDIVISIONS. In the public
notice of the application, the date, place and time fixed by the Board
DEPARTMENT of Health for the public hearing on the application
shall be stated. At the public hearing the applicant and any other
interested person shall be given an opportunity to present facts,
evidence, and arguments for or against the granting of the application.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.

AN ACT to repeal and reenact, with amendments, Section 229 (f) of
Article 81 of the Annotated Code of Maryland (1965 Replacement
Volume and 1967 Supplement), title "Revenue and Taxes," sub-
title "Maryland Tax Court," to allow the Maryland Tax Court to
remand any cause that may come before said court.
