(3) Nothing in this section shall be construed to prevent or pro-
hibit the Department of Research and Education and/or the Com-
mission of the
Department of Chesapeake Bay Affairs from conduct-
ing scientific investigations of any nature, at any time, by the use
of any devices, procedures or means, in any of the waters of Dor-
chester County or the waters of the Chesapeake Bay adjacent there-
to, anything, to the contrary in this section notwithstanding.

(t) Penalties; jurisdiction of violations; appealAny person vio-
lating any of the provisions of this section
EXCEPT SUBSECTION
(K) (7) shall be deemed guilty of a misdemeanor and upon convic-
tion thereof, unless otherwise herein specified, shall be fined not
more than two hundred dollars ($200.00)
.

ANY PERSON VIOLATING THE PROVISIONS OF SUBSEC-
TION (K) (7) OF THIS SECTION SHALL BE DEEMED GUILTY
OF A MISDEMEANOR AND UPON CONVICTION THEREOF
SHALL BE FINED NOT LESS THAN ONE HUNDRED DOL-
LARS ($100.00) NOR MORE THAN FIVE HUNDRED DOLLARS
($500.00).

(1)  Excepting violations of subsections (c) (d), (e), (g), and (k),

Any person found guilty by a court of law of three TWO violations
of the provisions of this section within any twelve (12) month period
may, in addition to the fine herein prescribed, have his license sus-
pended or revoked by the Department, after ten (10) days notice to
the licensee, served by registered mail to the addressee only, or by
personal service by the Department or its duly authorized officers.

(2)  All violations of this section by resident licensees, or by others
residing in Dorchester County, shall be tried by the trial magis-
trates of the county, anything to the contrary in this article not-
withstanding; but nothing herein contained shall deny to any de-
fendant the right to waive the jurisdiction of the trial magistrate,
or to appeal to the Circuit Court for Dorchester County from any
ruling, decision or finding of the trial magistrates. (1961, ch. 490;
1965, ch. 181; an. Code 1957, sec. 715B.)

715.

(A) IT SHALL BE UNLAWFUL FOR ANY PERSON, FIRM
OR CORPORATION TO TAKE, CATCH OR DREDGE SOFT-
SHELL CLAMS (MYA ARENARIA) FROM ANY COUNTY
WATERS IN WICOMICO COUNTY BY THE USE OF ANY
HYDRAULIC OR MECHANICAL DREDGES, ANY SUCH PER-
SON, FIRM OR CORPORATION SO DOING SHALL, UPON CON-
VICTION THEREOF BEFORE ANY JUSTICE OF THE PEACE,
BE FINED $500.00 AND THE COSTS.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
THAT BEFORE THIS ACT BECOMES EFFECTIVE
IT SHALL FIRST BE SUBMITTED TO A REFERENDUM OF
THE LEGALLY QUALIFIED VOTERS OF DORCHESTER
COUNTY AT THE GENERAL ELECTION TO BE HELD IN
NOVEMBER OF 1968. THERE SHALL BE PRINTED ON THE
BALLOTS OR BALLOT LABELS TO BE USED AT SAID ELEC-
TION THE TITLE OF THIS ACT AND UNDERNEATH SAID
TITLE, ON SEPARATE LINES, A SQUARE OR BOX TO THE
RIGHT OF AND OPPOSITE THE WORDS: "FOR................................. "
