fore any Justice of the Peace or Court of Justice of the county or city
where the offense was committed shall be fined Twenty Dollars
($20.00) for each and every offense and shall be committed to the
county jail or the Baltimore City Jail until such fine and costs are
paid, but such imprisonment shall not exceed twenty (20) days for
each offense. Any person convicted for fishing without proper
angler's license [, button or badge] in possession while fishing or
using any other person's license [ or button or badge], shall be con-
fiscated and the person upon whom it was found and the licensee
shall be disbarred from procuring an angler's license for a period of
one year. Any person found fishing or fishing for any species of fish
in non-tidal waters and who, through inadvertence, has not the
license on his or her person at the time of arrest but who shall pre-
sent same to the Court before whom he or she was convicted within
five (5) days after conviction, and if said Court, after making an
investigation, finds said license [and button or badge] which is
presented was duly issued prior to the apprehension of said person,
then at the discretion of said Court the fine shall be Five Dollars
($5.00) for each and every offense instead of Ten Dollars ($10.00)
as herein prescribed for residents and Twenty Dollars ($20.00) as
herein prescribed for non-residents.
221. Clerks' duties; sale of licenses by persons engaged in retail
business.
(a) Fees for issuance of licenses; disposition of money.—The
clerks of Courts or other persons authorized to sell such license
shall retain as compensation for issuing a license to a resident
EITHER A RESIDENT OR NON-RESIDENT of this State the
sum of twenty-five cents (25¢) and for issuing a license to a
non resident of this State, on and after January 1, 1966, the sum of
fifty cents (50¢) and shall on the first day of each and every month
transmit to the Department of Game and Inland Fish [Commission]
of the State all monies received by them for licenses, and such funds
shall be accounted for by the said [Commission] Department to the
[Comptroller of the State] Treasurer. The amount so received by the
[Comptroller] Treasurer shall be placed to the credit of a separate
fund known as the "State Game Protection Fund" and shall be
[disbursed] paid by the [Comptroller] Treasurer [from time to
time] on warrant[s] of the Comptroller [signed by the Director and
countersigned by a representative of the Commission] upon requisi-
tion of the Department of Game and Inland Fish. The monies in said
fund to the credit of the angler's license shall be used solely for the
salaries and expenses and for scientific investigations, protection,
and propagation of game fish and fresh water fishes.
(b) Lost license [, button or badge].—In case a person shall
lose his angler's license [and button or badge], he may make affi-
davit as to the date of issuance, number, description, as provided
therein giving name of clerk or person who issued said License and
with this information the [Commission] Department is authorized
to issue a duplicate angler's license [, and button or badge] at a
cost not to exceed [Seventy-five Cents (75¢)] One Dollar ($1.00).
(c) Complimentary licenses [, buttons or badges].—The [Com-
mission] Department is hereby authorized to issue annually not to
exceed twenty (20) complimentary angler's licenses [and buttons or
