to the prospective sale, rental, or lease.; OR TO FAIL TO ACCEPT
A LISTING BASED UPON THE OWNER'S DESIRE TO SELL,
RENT, OR LEASE WITHOUT REGARD TO RACE, COLOR, RE-
LIGIOUS CREED, OR NATIONAL ORIGIN.

(5)  To represent to any person because of race, color, religion,
or national origin that any dwelling is not available for inspection,
sale, rental, or lease when such dwelling is in fact so available.

(6)   To deny to any person because of race, color, religion, RE-
LIGIOUS CREED, or national origin, or because of the race, color,
religion,
RELIGIOUS CREED, or national origin of the person he
represents or may represent, access to or participation in any mul-

tiple listing service or other service or facilities related MEMBER-

SHIP IN ANY MULTIPLE-LISTING SERVICE RELATED to the

business of selling or renting dwellings.

(7)   To engage in any act or practice, the purpose of which is to
limit or restrict the availability of homing
ANY DWELLING to any
person or group of persons because of race, color, religion,
RE-
LIGIOUS CREED, or national origin.

(8)  To induce or attempt to induce any person to sell, rent, or
lease any dwelling by representations
MISREPRESENTATIONS
regarding the present or prospective entry into the neighborhood of
a person or persons of a particular race, color, religion,
RELIGIOUS
CREED, national origin, or economic status.

(b) Nothing in this section shall apply to an owner with respect

to the sale, lease, or rental by him of a portion of a building or

structure which contains living quarters occupied or intended to be
occupied by no more than four families living independently of each

other if such owner actually occupies one of such living quarters as

his residence.

(c)  Nothing in this section shall bar any religious or denomina-
tional institution, or any charitable or educational institution or or-
ganization which is operated, supervised or controlled by or in
conjunction with a religious organization, or bona fide private
or fraternal organization, from giving preference to persons of the
same religion
RELIGIOUS CREED or denomination, or to members
of such private or
fraternal organization, or from making such
selection as is calculated by such organization to promote the re-
ligious principles or the aims, purposes, or fraternal principles for
which it is established or maintained.

(d)  Nothing in this section shall affect, or be construed to affect,
any liability for payment of a real estate or other commission
by any person with respect to the sale, lease, or rental of a dwelling.

(E) NOTHING IN THIS SECTION SHALL AFFECT OR BE
CONSTRUED TO AFFECT THE RIGHTS OF ANY BONA FIDE
PURCHASER, SELLER OR TENANT ACTING IN GOOD FAITH.

(e) Nothing in this section shall prohibit, or be construed to pro-

hibit, a real estate broker, agent, or salesman, or employee or agent

of any real estate broker, agent, or salesman from complying with

the express written instruction of any person not in the business

of building, developing, selling, renting, or leasing dwellings, or
otherwise not subject to the prohibitions of this section pursuant to
subsection (b) or (c) hereof, with respect to the sale, rental, or lease
