CHAPTER 338
(House Bill 962)

AN ACT to repeal and re-enact, with amendments, Section 1C of
Article 43 of the Annotated Code of Maryland (1965 Replacement
Volume), title "Health," subtitle "State Board of Health and
Mental Hygiene to appoint the employees necessary for the opera-

tion of the Board and to give the Board power to set the salaries

of such employees TO AUTHORIZE THE BOARD OF HEALTH
AND MENTAL HYGIENE TO APPOINT ITS EMPLOYEES
AND TO AUTHORIZE IT TO HAVE SUCH FUNDS AS IT
NEEDS FOR ITS OPERATIONS.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 1C of Article 43 of the Annotated Code of Maryland
(1965 Replacement Volume), title "Health," subtitle "State Board
of Health and Mental Hygiene," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

1C.

The State Board of Health and Mental Hygiene shall consist of
eleven members as follows: Five shall be experienced physicians,
two of whom shall be qualified and experienced psychiatrists
specializing in the care and treatment of the mentally ill. One of the
members shall be a dentist. Each of the remaining members shall
be persons experienced and qualified in one of the following fields:
Dentistry, hospital administration, public administration, nursing,
pharmacy, radiation control and sanitary engineering. The members
of the Board of Health and Mental Hygiene shall be appointed by
the Governor, with the advice and consent of the Senate, for terms
of six years. The Governor shall appoint said members biennially
in groups of four, four and three, respectively, with at least one
physician among each group of appointees. The Governor shall ap-
point four members for a term expiring on the first Monday of May,
1963; four members for a term expiring on the first Monday of
May, 1965; and three members for a term expiring on the first
Monday of May, 1967; and in the event of a vacancy caused by
death, resignation, or otherwise, the Governor is authorized to ap-
point a qualified person to fill the vacancy in accordance with Section
11 of Article 2 of the Constitution of Maryland. No Board member
shall serve more than two full terms. The Board shall not have
any elected or appointed State, county or municipal public official
or employee appointed thereto. The Board shall biennially elect its
own chairman and vice-chairman. [The Board shall be furnished
with necessary secretarial services by the departments.] The Board
shall appoint such professional, staff and other employees as it
deems necessary for the operations of the Board. The salaries of
