Sec. 2. And be it further enacted, That this Act shall take effect

CHAPTER 316

(House Bill 883)

AN ACT to repeal and re-enact, with amendments, Section 258(b)
of Article 56 of the Annotated Code of Maryland (1964 Replace-
ment Volume), title "Licenses," subtitle "Home-Improvement
Law," subheading "Refusal or revocation of license for untrust-
worthiness, fraud, bad faith, etc.," to provide that the Maryland
Home-Improvement Commission shall not grant a license to any
person, nor shall it continue a license already issued, where the
Commission finds that the home improvement transactions of the
management personnel of the person have been marked by a
practice of failure to perform contracts, or by the manipulation
of assets or accounts, or by fraud or bad faith.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 258 (b) of Article 56 of the Annotated Code of Mary-
land (1964 Replacement Volume), title "Licenses," subtitle "Home-
Improvement Law," subheading "Refusal or revocation of license
for untrustworthiness, fraud, bad faith, etc.," be and it is hereby
repealed and re-enacted, with amendments, and to read as follows:

258.

For the protection of the people of this State, the Commission
shall not grant a license to any person, nor shall it continue a license
already issued where the Commission finds that:

(b) the home-improvement transactions of the person, or the
management personnel of the person,
have been marked by a practice
of failure to perform contracts, or by the manipulation of assets
or accounts[;], or by fraud or bad faith.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.
