Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 9A be and it is hereby added to Article 78A of the
Annotated Code of Maryland (1965 Replacement Volume), title
"Public Works," subtitle "Board of Public Works," and to read as
follows:
9A.
The Board of Public Works may condemn property to be acquired
for State use, except that which is in connection with State roads,
bridges, and highways. Such condemnation is subject to the provi-
sions of Article 33A of the Annotated Code of Maryland.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

CHAPTER 191
(House Bill 13)
AN ACT to repeal and re-enact with amendments Section 241 (c) of
Article 77 of the Annotated Code of Maryland (1965 Replacement
Volume and 1966 Supplement), title "Public Education," subtitle
"Chapter 23. School Attendance," to remove the one-year residence
requirement from the section relating to non-public school place-
ments of handicapped children of Maryland residents.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 241 (c) of Article 77 of the Annotated Code of Mary-
land (1965 Replacement Volume and 1966 Supplement), title "Public
Education," subtitle "Chapter 23. School Attendance," be and it is
hereby repealed and re-enacted with amendments to read as follows:
241.
(c) In the City of Baltimore or in any county in the State which
does not provide such special classes or special instruction for the
education of mentally or physically handicapped children, and such
mentally or physically handicapped children attend a school within or
outside of the State of Maryland providing appropriate instruction
or receives appropriate special instruction approved by the State
Board of Education, the board of education in the City of Baltimore
or county in which the parents of such child reside, provided such
parents [have been] are bona fide residents of the State of Maryland
[for more than one year], will be reimbursed by the State of Mary-
land not to exceed six hundred dollars ($600.00) for each such men-
tally or physically handicapped child each school year through the
appropriated funds in the public school budget to assist in paying the
tuition and/or fees incident to the instruction of each said handi-
capped child; except that in special cases where the child requires
extensive therapy or services in addition to special instruction the
State Board of Education shall determine the amount of reimburse-
ment and such amount may exceed six hundred dollars ($600.00).
