(Senate Bill 26)
AN ACT to repeal and re-enact, with amendments, Section 756 and
758 of Article 66C of the Annotated Code of Maryland (1957 Edi-
tion and 1966 Supplement), title "Natural Resources," subtitle
"Water Resources," subheading "Shore Erosion Control," and to
repeal Section 757 of said article, subtitle, and subheading of
said code, specifying the duties of the Department of Chesapeake
Bay Affairs, providing for the financing of design and erection of
shore protective devices by State Funds, removing reference to the
Department of Tidewater Fisheries from the conduct of the shore
erosion program providing for the financing thereof and defining
and increasing the State's share, and relating generally to shore
erosion control.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 756 and 758 of Article 66C of the Annotated Code
of Maryland (1957 Edition and 1966 Supplement), title "Natural
Resources," subtitle "Water Resources," subheading "Shore Erosion
Control," be and they are hereby repealed and re-enacted, with
amendments, and that Section 757 of the said article, subtitle,
and subheading, be and it is hereby repealed, to read as follows:
756.
(a) [There is hereby established within the Department of Tide-
water Fisheries a section of shore erosion control. This section]
The Department of Chesapeake Bay Affairs shall have the following
powers and duties:
(b) To develop and implement a program to educate the public on
all phases of shore erosion, its causes, its effects, the locations where
erosion is a problem, and steps to be taken to control erosion.
(c) To review petitions for formation of shore erosion districts
presented to any of the counties or Baltimore City and to report to
the counties or Baltimore City as provided by Section 167B of
Article 25 of this Code.
(d) To provide technical assistance to individual property owners,
municipalities and counties having specific shore erosion problems.
(e) To design, or cause to be designed, shore erosion control struc-
tures, including vegetative cover in shore erosion control districts.
(f) To enter into agreements with persons, municipalities or
counties for construction of shore erosion structures.
(g) To supervise, or secure supervision of, the design and erection
of all shore protective devices financed wholly or in part by State
funds.
(h) Prepare requests for appropriation of funds necessary to pay
the State's share of the cost of any shore protective devices.
(i) To cooperate with the following agencies:
1. The State Roads Commission for shore erosion control where
essential to protect municipal, county or State roads.
