CHAPTER 645
(Senate Bill 713)

AN ACT to repeal and re-enact, with amendments, Section 330 of
Article 77 of the Annotated Code of Maryland (1966 Supple-
ment) , title "Public Education", subtitle "Chapter 37. Educational-
Cultural Television", amending the laws relating to Statewide
Educational and Cultural television to extend the provisions
thereof to include radio broadcasting and to amend the subtitle
in accordance therewith.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 330 of Article 77 of the Annotated Code of Maryland
(1966 Supplement), title "Public Education", subtitle "Chapter 37.
Educational-Cultural Television", be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

330.

(a)   The Maryland Educational [-Cultural Television] -CUL-
TURAL Broadcasting Commission is created to develop, operate and
maintain a system of State, regional and local facilities to provide
educational and cultural television and radio programming in the
State. The Commission shall annually prepare a budget request to
provide funds required to properly perform these functions and shall
employ such personnel as may be required to fulfill the responsibili-
ties of the Commission and to coordinate all functions of the tele-
vision [system] and radio systems.

(b)    (1) The Maryland Educational [-Cultural Television] -CUL-
TURAL Broadcasting Commission shall consist of eleven (11) mem-
bers to be appointed by the Governor. From time to time the Gov-
ernor shall designate one person to be chairman and another to be
vice-chairman of the Commission.

(2)   Of the persons first appointed to the Commission, three shall
be appointed for terms of five years; three, for four years; three,
for three years; and two, for two years. As these initial appoint-
ments expire all appointments shall be for terms of five years. A
member whose term is expiring may be reappointed to another term.
Vacancies shall be filled from time to time for the remainder of the
term left vacant.

(3)   The members of the Commission shall be chosen from resi-
dents of Maryland and shall be broadly representative of the State
as a whole, and shall include persons especially skilled in such fields
as public or private education, libraries, art, music, drama, higher
education, the television and radio industries, or other categories
chosen by the Governor to bring special competence to the Commis-
sion's membership. Of those appointed to the Commission, one
member shall be the State Superintendent of Schools and two other
members shall be designated by the State Board of Education.

(4)   The members of the Commission shall not receive compensa-
tion for their membership on the Commission but they may be reim-
bursed for necessary and proper expenses incurred in their attend-
