Sec. 2. And be it further enacted. That this Act shall take effect

(Senate Bill 458)
AN ACT to add a new Section 689A to Article 43 of the Annotated
Code of Maryland (1965 Replacement Volume), title "Health,"
subtitle "Radiation Control," to follow immediately after Section
689 thereof, authorizing the State Board of Health AND MENTAL
HYGIENE to license and register and exempt from licensing and
registration uses or users of ionizing radiation and special nuclear
materials or devices, and giving the Commissioner of Health
authority in the event of an emergency to impound sources of
ionizing radiation under certain circumstances.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 689A be and it is hereby added to Article 43 of
the Annotated Code of Maryland (1965 Replacement Volume), title
"Health." subtitle "Radiation Control," to follow immediately after
Section 689 thereof, and to read as follows:
689A.
(a) The Board shall promulgate regulations for general or specific
licensing of ionizing radiation sources and by-products, special nu-
clear materials, or devises or equipment utilizing such materials.
Such regulations shall provide for amendment, suspension or revoca-
tion of licenses.
(b) The Board shall require registration or licensing of other
sources of ionizing radiation.
(c) The Board is authorized to exempt certain sources of ionizing
radiation or kinds of uses or users from the licensing or registration
requirements set forth in this section when the Board makes a find-
ing that the exemption of such sources of ionizing radiation or kinds
of uses or users will not constitute a significant risk to the health
and safety of the public.
(d) Regulations promulgated pursuant to this section may pro-
vide for recognition of other state or federal licenses as the Board
may deem desirable, subject to such registration requirements as
the Board may prescribe.
(e) The Commissioner of Health is authorized in the event of an
emergency to impound or order the impounding of sources of ionizing
radiation, in the possession of any person who is not equipped to
observe or fails to observe the provisions of this section or any of
the regulations promulgated hereunder.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.
