ures", subtitle "Apples", be and they are hereby repealed; and that
new Sections 37 through 45, inclusive, be and they are hereby enacted
in lieu thereof, to stand in the place of the sections so repealed, and
to read as follows:

37.

No person shall pack, possess, expose, store or transport for sale,
or sell, or in any manner represent for sale, apples in closed pack-
ages, except as provided in this subtitle.

38.

The Maryland standards of grades for apples shall hereafter
be the current United States Standards for Apples, as provided,
amended, revised and made effective from time to time by Federal
statute and duly promulgated regulations of the United States De-
partment of Agriculture, unless otherwise provided by duly promul-
gated regulations of the Maryland State Board of Agriculture.

39.

No person shall pack, sell or offer to sell, possess, or transport
any apples in closed packages not properly designated with respect
to the following: (1) a grade standard, as provided in this subtitle,
(2) the variety, (3) the minimum size, (4) a count or quantity
declaration and (5) the name and address of the packer or distribu-
tor. Said designation shall be plainly and conspicuously shown on
each package, provided however in transparent consumer packs,
stuffers may be used for markings and placed inside such packages
in a manner that is plainly readable.

40.

When apples are packed in used packages, any markings pertain-
ing to previous contents of such packages not applicable to new con-
tents shall be obliterated and the declarations required under this
subtitle shall be required.

The Maryland State Board of Agriculture through its duly ap-
pointed agents and enforcing officers, is hereby authorized, directed
and empowered to enforce the provisions of this subtitle and shall
have the power to define, promulgate and enforce such reasonable
rules and regulations as may be deemed necessary therefor and as
may be not inconsistent therewith.

In order to carry out the provisions of this subtitle, the State
Board of Agriculture, or its agents and employees, are authorized
to enter during the usual hours of business, any packing shed, ware-
house, cold storage, store, building, market or any other place,
carrier, conveyance, or vehicle at, in or from which any apples are
packed or sold, offered or exposed for sale for the purpose of deter-
mining whether the provisions of this subtitle or the rules and reg-
ulations lawfully promulgated in pursuance thereof shall have been
violated; and in addition, if the Board finds that the apples in his
possession are in violation of any of the provisions of this subtitle,
or of any rule or regulation promulgated pursuant thereto, it may
issue a written or printed "stop sale" order to the person so acting
in violation; and it shall be unlawful for such person, after receipt
