water works; to require the examination of operators SUPERIN-
TENDENTS and to certify their competency to supervise the
operation of such works; to prescribe the powers and duties of the
State Health Commissioner and the Director of the Department
of Water Resources in these matters; to authorize the Board of
Health and Mental Hygiene and the Water Resources Commission
to adopt regulations to carry out this Act; to create a Board of
Certification and to prescribe penalties for violations of this Act.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 406A be and it is hereby added to Article 43 of the
Annotated Code of Maryland (1965 Replacement Volume), title
"Health", subtitle "Water, Ice and Sewerage", to follow immediately
after Section 406 thereof, and to read as follows:

406A.

(a)  It is the intention of the General Assembly in the enactment
of this Section to establish a certification program for operators
SUPERINTENDENTS of water works, wastewater works and in-
dustrial wastewater works so as to further protect the public health
and the quality of the waste-receiving waters, and to prevent
pollution.

(b)  For purposes of this Section, the following definitions shall
apply:

"Water works" shall mean those facilities used in the procurement,
treatment, storage, pumping or distribution of water for human
consumption. It shall not include any facility used exclusively by a
private residence.

"Wastewater works" shall mean those facilities used in the col-
lection, transmission, storage, pumping, treatment or discharge of
any liquid or water-borne waste, whether it be either of domestic
origin or a combination of domestic, commercial and/or industrial
waste. It shall not include any facility used exclusively by a private
residence nor any facility utilizing septic tanks and subsoil absorption
nor industrial wastewater works.

"Industrial wastewater works" shall mean those facilities used in
the collection, transmission, storage, pumping, treatment or dis-
charge of any liquid, gaseous, solid or other waste substance or any
combination thereof resulting from any process of industry, manu-
facturing, trade or business, or from the development of any natural
resource.

"Responsible charge" shall mean responsible for the technical
operation
DAY-BY-DAY SUPERVISION of a water works, waste-
water works, or an industrial wastewater works, or any part thereof,
which may affect the performance of the works or which may affect
the quality of the water for human consumption or the quality of
the effluent produced by such works.

"Operator" "SUPERINTENDENT" shall mean an individual em-
ployed or appointed by any county, sanitary district, municipality,
corporation, company, institution, person, or the State of Maryland
who is designated by the employing or appointing officials as the
person in responsible charge of the actual operation of a water
