works, wastewater works or an industrial wastewater works. It is
not intended to include superintendents of public works, city engi-
neers or other municipal or industrial officials whose duties do not
include actual operation of such works,
, BUT IT IS INTENDED
TO INCLUDE THE FIRST LINE OF SUPERVISION.

(c) (1) The State Board of Health and Mental Hygiene shall adopt
and enforce such rules and regulations as may be necessary for the
administration of this Act. The rules and regulations shall include
but not be limited to the following: provisions for the classification
of operator
SUPERINTENDENT for a specific classification of
water works or wastewater works; provisions establishing qualifica-
tions of applicants; and procedures for applications and examina-
tions of such persons.

(c) (2) The Water Resources Commission shall adopt and enforce
similar rules and regulations which detail the manner in which
operators of industrial wastewater works shall be certified and other
such rules and regulations as may be necessary for the administra-
tion of this Act.

(d)(1) The State Health Commissioner shall classify all water
works and wastewater works. In determining the classification of a
works, consideration shall be given to its size or capacity, the type of
treatment included, the character of water or wastes treated and
other physical conditions affecting such works.

(d)(2) The Director of the Department of Water Resources shall
classify all industrial wastewater works under a similar criteria.

(e)(1) There is hereby created a Board of Certification com-
prised of eight
NINE members. The State Health Commissioner
GOVERNOR shall appoint to the Board a representative of munic-
ipal government, a representative of county government, a repre-
sentative of a sanitary or metropolitan commission, a currently
employed water works operator,
SUPERINTENDENT, a currently
employed wastewater works operator
SUPERINTENDENT, A
FARMER and an engineer representative of the State Department
of Health. The Director of the Department of Water Resources shall
appoint to the Board a currently employed industrial wastewater
works operator
SUPERINTENDENT and an engineer representa-
tive of his Department.

(e)(2) The representative of county government and the indus-
trial wastewater works operator
SUPERINTENDENT shall be ap-
pointed for an initial term of two years, the water works operator
SUPERINTENDENT and the wastewater works operator SUPER-
INTENDENT for an initial term of three years, and the representa-
tives of municipal government and a sanitary or metropolitan com-
mission for an initial term of four years; thereafter, all appointments
shall be for terms of four years each. The representatives of the
State Department of Health and the Department of Water Resources
shall serve on the Board at the pleasure of the respective appointing
authorities. Members of the Board shall be eligible for reappoint-
ment. Vacancies on the Board shall be filled for the remainder of
the unexpired term by the respective appointing authorities. The
Board at its first meeting each year shall select its Chairman. The
representative of the State Department of Health shall be designated
as Secretary to the Board.
