AN ACT to repeal and re-enact, with amendments, Section 165(a)
of the Code of Public Local Laws of Howard County (1965 Edition,
being Article 14 of the Code of Public Local Laws of Maryland),
title "Howard County," subtitle "Metropolitan Commission," and
to repeal Section 165(c) of the Code of Public Local Laws of
Howard County (1965 Edition, being Article 14 of the Code of
Public Local Laws of Maryland), title "Howard County," subtitle
"Metropolitan Commission," and to enact new Section 165 (c) in lieu
thereof, to stand in the place of the section repealed; relating to
the composition and appointment to the Metropolitan Commission
of Howard County, in order to delete those changes which were
declared invalid by the Court of Appeals; and to correct an error
therein.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 165(a) of the Code of Public Local Laws of Howard
County (1965 Edition, being Article 14 of the Code of Public Local
Laws of Maryland), title "Howard County," subtitle "Metropolitan
Commission," be and it is hereby repealed and re-enacted, with
amendments; and that Section 165(c) of the Code of Public Local
Laws of Howard County (1965 Edition, being Article 14 of the
Code of Public Local Laws of Maryland), title "Howard County," sub-
title "Metropolitan Commission," be and it is hereby repealed and
that new Section 165(c) be and it is hereby enacted in lieu thereof,
to stand in the place of the section repealed; and both to read as
follows:
165.
(a) For the purpose of carrying out the provisions of this sub-
title, the Metropolitan District created hereafter shall be under the
jurisdiction of a Commission of [four] three persons, [one] all of
whom shall be [a member of] appointed by the Board of County
Commissioners of Howard County, [designated by said Board to
serve; and the other three shall be appointed by said Board,] and
all of whom shall reside in Howard County, be resident taxpayers of
said County and qualified voters thereof. The term of each of the
three [appointed] members shall be six years or until their suc-
cessors are appointed and have qualified, except that the first Com-
missioner named by said Board of County Commissioners shall serve
for two years, the second for four years and the third for six years
from the date of their appointments, and as the term of each Com-
missioner expires, his successor shall be appointed by the Board of
County Commissioners of Howard County. Any vacancy in the
personnel of the Commission shall be filled by appointment by the
Board of County Commissioners of Howard County and for the
unexpired term [in the case of an appointed member].
165.
(c) In addition the County Commissioners shall appoint one of
its membership to sit at all meetings of the Metropolitan Commis-
sion. The secretary-treasurer appointed by the Commission shall
