commissions issued, and full power and authority are hereby vested
in each of said judges so designated and commissioned as chief judge
to act as such chief judge, and all writs and other process tested
in the names of said chief judges respectively are hereby declared
valid to all intents and purposes, as if this section had been in force
when the same were issued; provided, however, that this Section
shall not apply with respect to the Orphans' Court for Montgomery
County.
257.
The orphans' court, unless a different time is prescribed by the
local law, shall be held by each county and the City of Baltimore,
at the usual place of holding the court of said county or city, on the
second Tuesday in every month of February, April, June, August,
October and December, and oftener if need be, according to its own
adjournment; and any one of the judges of the said court, in the
absence of the others shall have power to hold the said court at a
stated time of adjournment only for the purpose of adjourning; any
two of them shall have full power to do any act which the said court
is or shall be authorized by law to perform, and any two of them shall
have power to hold the court on any day not named in an adjourn-
ment, on the application of any person having pressing business in
the said court; provided, notice thereof be given to all, and in such
case the register shall record that such notice hath been given. Any
one of the judges, in the absence of the others on account of pro-
longed illness, or in case of vacancy, shall have full power to do any
act which the said court is authorized by law to do, provided there
be attached to the proceedings or papers in each case a certificate
signed by the register of wills, certifying to the vacancy or to the
illness or inability of the judge or judges not attending said court
on said day. Provided, however, that in Montgomery County any
Judge of the Circuit Court for Montgomery County at the time
sitting as the Orphans' Court for said County shall have full power
to do any act which the Orphans' Court of said County is or shall be
authorized by law to perform, including the power to hold the court
on any day not named in an adjournment as hereinbefore provided.
288.
Beginning with November 5, 1946, the register of wills in each
county, before he acts as such, shall give bond to the State of Mary-
land in the penal sum of fourteen thousand dollars, and the Register
of Wills of Baltimore City, before he acts as such, shall give bond to
the State of Maryland in the penal sum of thirty thousand dollars;
said bonds shall be given by each of said registers, respectively, with
condition that he faithfully perform the duties of his office and
account for all funds received under color of his office, which bond
shall be taken and security or securities approved by the judges of the
orphans' court of which he is register and recorded in the office of
the clerk of the circuit court for the county or Baltimore City of
which he is register, and thereafter filed with the State Comptroller;
and every register shall give a new bond in like manner on or before
the first day of December of the second year following his qualifica-
tion in office; provided, however, that the bond of the Register of
Wills of Montgomery County shall be taken and security or securities
approved by the Judge of the Circuit Court for Montgomery County
at the time sitting as the Orphans' Court for Montgomery County.
