AN ACT TO REPEAL AND RE-ENACT, WITH AMENDMENTS,
SECTIONS 252(A) AND 252(D) OF ARTICLE 56 OF THE AN-
NOTATED CODE OF MARYLAND (1964 REPLACEMENT
VOLUME), TITLE "LICENSES," SUBTITLE "HOME IM-
PROVEMENT LAW," PROVIDING TENURE IN OFFICE FOR
THE EXECUTIVE DIRECTOR OF THE HOME IMPROVE-
MENT COMMISSION AND MERIT SYSTEM STATUS FOR
THE INVESTIGATORS EMPLOYED BY THE COMMISSION.

That new Section 9D be and it is hereby added to Article 64A of the
Annotated Code of Maryland (1964 Replacement Volume and 1965
Supplement), title "Merit System," to follow immediately after Sec
-
tion 9C thereof, and to read as follows:

Section 1. Be it enacted by the General Assembly of Maryland,
THAT SECTIONS 252(A) AND 252(D) OF ARTICLE 56 OF THE
ANNOTATED CODE OF MARYLAND (1964 REPLACEMENT
VOLUME), TITLE "LICENSES," SUBTITLE "HOME IMPROVE-
MENT LAW," BE AND THEY ARE HEREBY REPEALED AND
RE-ENACTED, WITH AMENDMENTS, TO READ AS FOLLOWS:

9D.

The position of Executive Director and of the investigators of the
Maryland Homo Improvement Commission are part of the merit
system, notwithstanding any other provisions of this Article or else-

where.

252.

(a) THE COMMISSION SHALL EMPLOY AN EXECUTIVE
DIRECTOR WHO SHALL BE A FULL-TIME EMPLOYEE OF
THE STATE. HE SHALL HOLD OFFICE DURING GOOD BE-
HAVIOR AND SHALL BE SUBJECT TO REMOVAL BY THE
COMMISSION OR BY A MAJORITY OF THE COMMISSION FOR
INCOMPETENCE OR NEGLECT OF DUTY; BUT BEFORE THE
EXECUTIVE DIRECTOR MAY BE REMOVED FROM OFFICE
HE SHALL BE GIVEN A COPY OF THE CHARGES AGAINST
HIM AND AN OPPORTUNITY OF BEING PUBLICLY HEARD
IN PERSON OR BY COUNSEL IN HIS OWN DEFENSE UPON
NOT LESS THAN TEN DAYS' NOTICE.

THE EXECUTIVE DIRECTOR SHALL:

(1)    TAKE CHARGE OF THE OFFICE OF THE COMMIS-
SION;

(2)    HAVE CUSTODY OF THE OFFICIAL RECORDS AND
THE SEAL; AND

(3)    COLLECT, ACCOUNT FOR, AND PAY OVER ALL FEES
REQUIRED BY THIS SUBTITLE IN SUCH MANNER AS MAY
BE DETERMINED BY RULE OR REGULATION OF THE COMP-
TROLLER OF THE STATE OF MARYLAND.
