Sec. 4. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 685
(Senate Bill 267)

AN ACT to repeal and re-enact, with amendments, Section 211C of
Article 89B of the Annotated Code of Maryland (1957 Edition,
1964 Replacement Volume), title "State Roads", sub-title "State
Highway Construction Bonds, Third Issue", and Sections 211H
and 211-1 of said Article 89B of said Code, under sub-title "Expen-
diture of Commission's Funds and Programming and Scheduling
of Highway Projects", increasing from $2,000,000 to $5,000,000
the amount of funds which may be spent for certain advance right
of way acquisitions for the fiscal years 1966, 1967 and 1968;
increasing from $500,000 to $1,000,000 the amount the Commis-
sion may expend annually for certain advanced engineering and
design projects, and to authorize the expenditure during any fiscal
year a sum not to exceed $3,500,000 for certain critical highway
construction and reconstruction projects and providing that funds
authorized for highway construction or reconstruction projects of
a critical nature not expended during any fiscal year shall revert
to the Highway Construction Fund.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 211C of Article 89B of the Annotated Code of Maryland
(1957 Edition, 1964 Replacement Volume), title "State Roads", sub-
title "State Highway Construction Bonds, Third Issue", be and are
IS hereby repealed and re-enacted, with amendments; that Sections
211H and 211-1 of said Article of said Code, under sub-title "Expen-
diture of Commission's Funds and Programming and Scheduling of
Highway Projects", be and it is ARE hereby repealed and re-enacted,
with amendments, and all to read as follows:

211C. The Commission shall at no one time issue bonds in an
amount greater than twenty-five million dollars ($25,000,000) and
it is further provided that no bonds shall be issued until the cash
balance in the Commission's Construction Fund is below twenty-five
million dollars ($25,000,000). The Commission by resolution may
authorize expenditures from bond issue proceeds and other funds
available to the Commission during any fiscal year in an amount
not to exceed the sum of two million dollars ($2,000,000) for the
purpose of acquiring rights of way for future State highway projects
included in the official "needs study" program of the Commission [.];
and during the fiscal years 1966, 1967 and 1968, the Commission
may by resolution authorize the further expenditure of three million
dollars ($3,000,000) in each of such fiscal years for such purposes.
The Commission may authorize expenditures for bond issue proceeds
and other funds available to the Commission during any fiscal year
in an amount not to exceed the sum of one million, five hundred
thousand dollars ($1,500,000) for projects due to storm and flood
