time employees of the county. The chief deputy and the deputy
sheriffs shall carry out their duties under the direction of the sheriff
[and of the Board of Public Safety]. The chief deputy and the deputy
sheriffs shall have the qualifications fixed by the [Board of Public
Safety] County Commissioners, provided that as a minimum, the
qualifications fixed shall not be less than the qualifications generally
required for law enforcement officers, providing, however, that it
shall be optional [with the Board] whether or not to apply
qualification requirements to deputies now holding office.
204.
(A) THERE SHALL BE ONE CHIEF DEPUTY SHERIFF FOR
THE COUNTY AND SIX (6) DEPUTY SHERIFFS, WHO SHALL
BE FULL TIME EMPLOYEES OF THE COUNTY APPOINTED
BY THE SHERIFF. THE CHIEF DEPUTY AND THE DEPUTY
SHERIFFS SHALL CARRY OUT THEIR DUTIES UNDER THE
DIRECTION OF THE SHERIFF. THE CHIEF DEPUTY AND
THE DEPUTY SHERIFFS SHALL HAVE THE QUALIFICA-
TIONS FIXED BY THE COUNTY COMMISSIONERS, PRO-
VIDED THAT AS A MINIMUM, THE QUALIFICATIONS FIXED
SHALL NOT BE LESS THAN THE QUALIFICATIONS GENER-
ALLY REQUIRED FOR LAW ENFORCEMENT OFFICERS,
PROVIDING, HOWEVER, THAT IT SHALL BE OPTIONAL
WHETHER OR NOT TO APPLY THESE QUALIFICATION RE-
QUIREMENTS TO DEPUTIES NOW HOLDING OFFICE. ALL
DEPUTY SHERIFFS SHALL ATTEND AND SATISFACTORILY
COMPLETE THE TRAINING PROGRAMS SPECIFIED IN SEC-
TION 204A (A) (III) OF THIS SUB-TITLE.
(B) THE CHIEF DEPUTY AND DEPUTY SHERIFFS AU-
THORIZED IN THIS SUB-TITLE SHALL HAVE THE RESI-
DENCE REQUIREMENTS REQUIRED IN THIS SECTION.
THREE SHALL RESIDE IN ANY OF THE FOLLOWING ELEC-
TION DISTRICTS OF THE COUNTY: FIRST, SECOND,
EIGHTH OR NINTH; TWO SHALL RESIDE IN EITHER THE
THIRD OR SIXTH DISTRICT; TWO SHALL RESIDE IN THE
FOURTH, FIFTH OR SEVENTH DISTRICTS.
204B.
(a) The chief deputy shall have responsibility for and be charged
with assisting the sheriff in the immediate supervision of the sheriff's
office including but without limitation:
[(b) No person shall be eligible for appointment as chief deputy
or deputy who is less than twenty-one years of age or who is more
than fifty years of age at the time of appointment. The provisions
of this sub-section shall not be applicable to any deputies in office on
June 1, 1963.]
[(c)] (b) The deputy sheriffs authorized in this sub-title shall have
the residence requirements required in this section. Three deputies
shall reside in any of the following election districts of the county:
first, second, eighth or ninth; one deputy shall reside in either the
third or sixth district; two deputies shall reside in the fourth, fifth
or seventh districts [;] . [and the remaining deputies shall reside in
the county at large.]
