title "Alcoholic Beverages", sub-title "Hours and Days for Sale",
changing the closing hours for all alcoholic beverage licensees in
Charles County. TO CHANGE THE HOURS AND DAYS OF
SALE OF ALCOHOLIC BEVERAGES IN CHARLES COUNTY
AND TO PROVIDE FOR THE EFFECT OF DAYLIGHT TIME
ON SUCH HOURS OF SALE.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 96 of Article 2B of the Annotated Code of Maryland
(1964 Supplement), title "Alcoholic Beverages", sub-title "Hours and
Days for Sale", be and it is hereby repealed and re-enacted, with
amendments, to read as follows:
96.
In Charles County, notwithstanding any other provisions of this
sub-title, it shall be unlawful for any licensee or any agent, servant or
employee of said licensee under this sub-title to sell liquors on the
Sabbath Day, commonly called Sunday, nor shall any liquors be sold
by any licensee or any agent, servant or employee of said licensee
between the hours of 12 midnight 2 O'CLOCK A.M. and 6 o'clock
A.M. regardless of whether the county be on daylight or regular time.
But this section shall not prevent any sale under a Class C license or
any other sale of wine or beer containing less than 20% alcohol by
volume on any day including Sunday, or at any time except between
the hours of [12 midnight] 3 2 o'clock A.M. and 6 o'clock A.M. The
barroom where alcoholic beverages are sold or displayed shall be
closed at [midnight,] 2 o'clock A.M. and all bottles and containers used
in dispensing alcoholic beverages must be removed from the tables
on or before [1:00] 2:00 A.M. THIS TIME. THE HOURS ESTAB-
LISHED IN THIS SECTION FOR THE SALE OF ALCOHOLIC
BEVERAGES ARE HEREBY DECLARED TO BE IN ACCORD-
ANCE WITH EASTERN STANDARD TIME WHENEVER SUCH
TIME IS IN EFFECT OR IN ACCORDANCE WITH DAYLIGHT
TIME WHENEVER SUCH TIME IS IN EFFECT. Any person
violating any of the provisions of this section shall be deemed guilty
of a misdemeanor and upon trial and conviction shall be subjected to
a fine of not less than fifty dollars ($50.00) nor more than two
hundred and fifty dollars ($250.00), or may be confined in the
county jail or in the house of correction for not less than sixty days,
or both, in the discretion of the court.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.
