The County Commissioners of Charles County are hereby author-
ized, empowered and directed to adopt a building Code for the County
as soon as is practicable after the effective date of this Act.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 393
(House Bill 423)

AN ACT to add new Section 29B to the Code of Public Local Laws of
Charles County (1964 Supplement, being Article 9 of the Code of
Public Local Laws of Maryland), title "Charles County," subtitle
"Building Permits," to follow immediately after Section 29A there-
of, as added by Chapter 876 of the Acts of 1961; to require that test
borings in Charles County of holes, ditches, and wells be always
kept covered with qualifications and upon completion of the job
that they be back filled or covered with permanent coverings, with
penalty for violations thereof.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 29B be and it is hereby added to the Code of Public
Local Laws of Charles County (1964 Supplement, being Article 9 of
the Code of Public Local Laws of Maryland), title "Charles County,"
subtitle "Building Permits," to follow immediately after Section 29A
thereof, as added by Chapter 876 of the Acts of 1961, and to read as
follows:

29B.

All test borings, ditches or wells of any kind dug into the ground
for construction jobs and other building projects or for any purpose
in Charles County leaving holes or precipitous trenches in the ground
of a dangerous nature, holes three feet deep or more in which a child
or animal may become entrapped or which are dangerous because of
their concealed nature not including cellar type excavations, man-
made ponds or the like which can be readily observed, entered or va-
cated without assistance, shall be covered when not in attendance or
their existence shall be identified by a barricade of some sort
or by
warning signs, and upon completion of the construction or building
project said borings shall be back-filled or covered with permanent
type coverings. Any violation of the provisions of this section shall
be a misdemeanor punishable by a fine not to exceed $250.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.
